Are you going to have a real estate attorney review the lease or purchase agreement? One of the most important questions to ask of a potential tenant/buyer or landlord/seller early in negotiations.

I read the Biden-Harris National Strategy to Acclerate Deployment of Zero Emission Infrastructure for Freight Trucks. In a nutshell, they propose a staged framework to guide future investment and governance at the State and Federal Level.

We have looked at several deals over the past year involving industrially zoned property impacted by a "higher and better" use overlay that makes it impossible to operate as industrial unless the use / improvements do not change (i.e. the current occupant continues to operate as-is). In every instance, the overlays have likely cost the owner significant amounts of market value. How is this legal?
