#Colombia: En Oct. 2013, Fidupetrol, contactó al abogado Rodrigo Escobar Gil, con el fin de consultarle sobre un proceso de tutela, a cargo de otro abogado, que esa entidad llevaba contra la Corte Suprema ante la Corte Constitucional pendiente de revisión. Confirmó los fallos.

Esta Relatoría, sigue esperando información sobre dichas medidas, pues la contestación del Estado del 25 de julio no informa de los pasos correctivos adoptados ni sobre la demora de casi cuatro años de la Corte Suprema de Justicia en resolver el recurso de casación presentado.

ECtHR (Başer & Özçelik v. TR), § 167 : "when referring to the “special trust and loyalty” that they [judges] must observe, it is loyalty to the rule of law and democracy and not to holders of State power."

Aquí corresponde recordar los Principios Básicos de la Independencia de la Judicatura vigentes desde 1985. Todas las instituciones gubernamentales y de otra índole respetarán y acatarán la independencia de la judicatura (principio 1). Una orden judicial firme debe ser cumplida.

Por el ejercicio de sus derechos, fue detenido el 14 de junio y trasladado a una base militar en donde estuvo incomunicado durante 17 horas. Luego se le habrían imputado cargos por paralización de servicio público, obstrucción de vía pública. La Fiscalía emitió cargos.
