The U.S. Department of the Treasury and the Internal Revenue Service issued proposed regulations to implement the new Federal Scholarship Tax Credit under section 25F, commonly known as the Education Freedom Tax Credit, the first federal tax credit supporting private contributions for K-12 scholarships.
Under the proposed regulations, eligible taxpayers may claim an annual credit of up to $1,700 for qualifying contributions, or up to $3,400 for married couples filing jointly. Treasury and the IRS also issued companion temporary regulations to establish key procedures for states and Scholarship Granting Organizations to prepare for the launch of the tax credit on January 1, 2027.
The proposed regulations advance the Administration’s priorities of expanding educational freedom, restoring parental rights, returning power to the states, and putting American students first.

It might seem too good to be true, but starting Jan. 1, 2027, taxpayers will be able to get a dollar-for-dollar tax credit by donating to a scholarship organization. Tony de Nicola, co-founder of @Invest_InEd, is on a mission to educate people and help them take advantage of this opportunity to help students across the country.

These @MorningConsult poll results on the Federal School Choice Tax Credit program are remarkably similar to our own polling here in Maryland. More Democrats support @GovWesMoore @iamwesmoore opting into the program than Republicans. #GetWesToYes investineducation.org/nation…

“Nonparticipation would leave New York families at a disadvantage while taxpayers send their contributions to fund scholarships elsewhere.”
By opting in @GovKathyHochul will help low-income NY students with expenses like tutoring and after school activities. And avoid sending all NY contributions to other states that have already opt in…

.@GovKathyHochul understands that every child in NY deserves the opportunity to succeed.
More tutoring. More after school programs. More essential services. No impact on NY's budget.
More access creates more opportunity.
That's a win for every student in New York.

WA teachers spend $1,041/year on classroom supplies out of pocket — 11th highest nationally. A new federal tax-credit scholarship could fix that, but Gov. Ferguson must opt in before Jan. 1, 2027. clarkcountytoday.com/opinion… #Opinion #WashingtonState

I was proud to stand alongside @Invest_InEd coalition partners in Chicago yesterday to call on @GovPritzker to opt in to FSTC. Tutoring. After-school programs. Special needs services. School choice. All funded by private donations. And all within reach if he acts.

Yesterday, I spoke at a press conference urging Governor Shapiro to opt Pennsylvania into a new federal tax credit that could unlock billions of dollars in education scholarships for students across our Commonwealth.
“If Pennsylvania does not opt in, residents here can still claim the [tax] credit, but their donations will go to scholarships in other states,” state Rep. Martina White, a Republican who represents parts of Philadelphia, said at a press conference on Thursday. “In other words, Pennsylvania taxpayers will help fund scholarships elsewhere while our students miss out.”

Happy #NationalSchoolChoiceWeek!
Every child deserves a great education, no matter their zip code or family income. That’s why I worked to pass the Working Families Tax Cut Act, which created a $1,700 tax credit to support scholarships and expand school choice.
This helps level the playing field for low- and middle-income families without taking a single dollar from public schools. Every child deserves an education that inspires them and helps them achieve the American Dream, regardless of their family’s financial situation.

Peter Murphy of @Invest_InEd wrote a great piece on the federal Education Choice for Children Act (ECCA), which represents a significant but still underappreciated development in education policy in that it channels private, voluntary dollars toward K-12 students without reducing public school funding or growing state budgets. 👇 newsmax.com/newsfront/educat…
The policy design is deliberate: participation is state-driven, neutral across educational settings, limited per donor, and administered through nonprofit scholarship-granting organizations. As Peter outlined, governors effectively decide whether new philanthropic resources benefit families in their own states or are redirected elsewhere.
This is not an ideological exercise but a question of public leadership and whether to expand family-level access when additional, non-government resources are available, or to preserve existing systems at the expense of opportunity.
Grateful for the leadership of @CSFNational and Invest in Ed, among others for advancing smart, child-centered policy.
