As the PCSA has passed in the Senate, college athletes and their representatives should review relevant #NIL contracts, agency agreements, and eligibility circumstances to determine how to effectively navigate the potentially forthcoming landscape. frieserlegal.com/as-pcsa-pas…

Thanks to @InsideTheLeague Neil Stratton for having me on the @RightStepAdv (Scouting the League) podcast. We had a robust discussion on the implications of the PCSA, which has passed in the Senate and is pending in the House of Representatives. youtube.com/watch?v=M_-NZ2pl…

Another state court TRO... and a name that may be of interest to at least some of my followers. Former Boise State DT Braxton Fely was granted a TRO by an Oklahoma state court to allow him to suit up for the Sooners pending a preliminary injunction hearing.

The funniest possible thing that could happen is one of these state attorneys general filing a lawsuit directly with the U.S. Supreme Court. The Supreme Court has original and exclusive jurisdiction over legal disputes between two or more states. No district court needed.

In 2021, I pitched a few lawyers on building a practice in the NIL space. They all told me the same thing: "there's no money there." Something along the lines of college town pizza shops won't pay Big Law hourly rates for a $500 NIL deal. Well... times have certainly changed.
BREAKING: The SEC has filed a lawsuit against LSU and head football coach Lane Kiffin, @PeteNakos reports. "Defendants waged a deliberate and coordinated campaign to recruit professional athletes to play football for LSU during the 2026-27 season." on3.com/news/sec-files-lawsu…

Louisiana has amended its athlete agent law, bringing sweeping changes to the state’s legislation regulating athlete representatives. The legislation broadens the coverage of the state’s athlete agent law to include individuals acting as #NIL agents. frieserlegal.com/louisiana-h…

Louisiana’s recently introduced SB389 would extend agent oversight to college & high school athletes, mandate training, background checks, social media disclosure, heavy fines, and new legal rights for athletes. Essentially, it’s the RUAAA with teeth. legis.la.gov/legis/BillInfo.…

Thanks to @KellisRobinett for including my thoughts on the forthcoming Jerome Tang/K-State contract dispute.
I showed Jerome Tang's contract to some experts in sports law. Here's what they had to say about Kansas State firing him "for cause." Who wins if this $18.7 million legal battle goes to court? Enlightening opinions in here⬇️ 🦅kansas.com/sports/college/bi… ⭐️kansascity.com/sports/colleg…

Not every NIL deal is what it looks like on paper. These clauses matter more than you think. 👀 #TheProtectUCrew @MickensJay @JoshFrieser 🔗: youtu.be/b_vuWfTnTfo?si=vR5x…

I 100% agree. There are also “qualified individuals” (on paper), e.g. lawyers that are not practitioners in this space, NFL agents, etc., that have caused huge issues. Just this cycle I saw multiple contracts negotiated by agents at global sports agencies that screwed guys.
Someone needs to do something about all of the unqualified individuals calling themselves agents and soliciting college athletes. I've heard too many bad stories and reviewed too many bad contracts.

Many (including myself) have speculated that this December/January cycle will be when schools start to enforce contractual terms against transferring athletes. A few takeaways here in my eyes: (1) Athletes and agents need to understand what they are agreeing to ahead of time.
Many colleges have been hesitant to test the legality of buyout clauses when a player transfers mid-NIL contract. Georgia is testing its clause in court, asking for $390k from standout pass rusher Damon Wilson, who transferred to Mizzou in January. espn.com/college-football/st…

Particularly for schools that have refused to negotiate terms (i.e., have told athletes that contracts are take it or leave it), there is a lesser likelihood that some of these terms will be enforceable. (3) How would a court or arbitrator calculate the lost value of the breach?

After all, the schools keep insisting (and including in their contracts) that these deals are not pay-for-play. In other words, what is the real value of the NIL license that UGA/its collective lost out on? Based on Wilson's 17.5k Instagram followers, it is probably not $390k...
