The Supreme Court on Friday clarified its March 11 judgment on determining the creamy layer status of OBC candidates, while rejecting the Centre's plea seeking modification of the ruling.
The court reiterated that parents' salary income alone cannot determine a candidate's creamy layer status; the category of posts held by the parents must also be considered.
Clarifying the scope of its judgment, the SC said it would apply to the parties before it and that existing seniority and promotions would not be reopened. Pending cases will be decided by courts on their own merits and entitlement. The deadline to comply with the judgment has been extended by eight week

ఓబీసీల క్రీమీ లేయర్‌కు సంబంధించి సుప్రీంకోర్టు ఈరోజు తన ఉత్తర్వును సమర్థించింది. ఆదాయ గణనలో జీతం మరియు వ్యవసాయ ఆదాయాన్ని పరిగణనలోకి తీసుకోకూడదని ఈ ఉత్తర్వులో స్పష్టంగా పేర్కొంది.
ఉదాహరణకు, మీరు ఇన్ఫోసిస్‌లో సాఫ్ట్‌వేర్ ఇంజనీర్‌గా పనిచేస్తూ ఏడాదికి రూ.15 లక్షల జీతం పొందుతున్నట్లయితే, ఓబీసీల క్రీమీ లేయర్‌ను నిర్ణయించే ఆదాయ గణనలో మీ జీతాన్ని పరిగణనలోకి తీసుకోరు.
అయితే, రూ.15 లక్షల జీతం పొందే ఈడబ్ల్యూఎస్ (EWS) వర్గానికి చెందిన వ్యక్తి రిజర్వేషన్‌కు అనర్హుడవుతాడు. కానీ అదే జీతం పొందే ఓబీసీ వ్యక్తి మాత్రం కేవలం ఆ జీతం కారణంగా రిజర్వేషన్‌కు అనర్హుడు కాడు.
దీని వెనుక ఉన్న సూత్రం ఏమిటంటే, ఓబీసీలలో క్రీమీ లేయర్ అనేది కేవలం ఆర్థిక స్థితిగతుల ఆధారంగా నిర్ణయించేది కాదు; అది సామాజిక హోదా ఆధారంగా నిర్ణయించబడుతుంది.
ఒక వ్యక్తి సామాజిక హోదా పెరిగినప్పుడు మాత్రమే అతడిని సామాజికంగా అభివృద్ధి చెందిన వర్గానికి చెందిన వ్యక్తిగా పరిగణించవచ్చు.
గతంలో వెలువడిన వివిధ న్యాయ తీర్పులను పరిశీలించిన న్యాయస్థానాలు, తరతరాలుగా అపారమైన ఆస్తులు కలిగిన సంపన్న భూస్వాములు, పెద్ద సంఖ్యలో ఉద్యోగులను నియమించుకునే వ్యాపార సంస్థల యజమానులను మాత్రమే క్రీమీ లేయర్ పరిధిలోకి తీసుకురావాలనే ఉద్దేశం ఉందని స్పష్టం చేశాయి. తగినంత సామాజిక హోదా లేని సాధారణ జీతభత్యాల ఉద్యోగులను లక్ష్యంగా చేసుకోవడం ఈ విధానం ఉద్దేశం కాదని పేర్కొన్నాయి.
ఓబీసీలలో క్రీమీ లేయర్ అమలుకు సంబంధించి ఇది ఒక కీలకమైన చారిత్రాత్మక తీర్పు.
ఇలాంటి తీర్పులను చూసినప్పుడల్లా మరింతగా రాయాలనే ప్రేరణ నాకు కలుగుతుంది.

Panchkula School Survivor-Girl returns home as she gets a warm emotional welcome from her family and loved ones 🥲❤️
After days of worry, treatment and uncertainty following the disturbing incident at her school, the little girl is finally back in the comfort of her home, surrounded by the people who love her the most. The 6-year old survivor had reportedly sustained injuries after a 8-year old boy brutally assaulted her at a school in Panchkula, Haryana, which sparked widespread concern and discussion about children's safety in educational institutions.
Relatives gathered to greet her with flowers and balloons, and her parents were overwhelmed with emotion as she returned. The family had endured days of fear while she received treatment at the Postgraduate Institute of Medical Education and Research (PGIMER) in Chandigarh.
However, her discharge does not necessarily mean that her recovery is complete. Her family has indicated that she still needs time to recover physically and emotionally. The priority now is to provide her with a peaceful, supportive environment where she can regain her confidence and feel safe again.
Sometimes, the most beautiful news is simply that a child has made it home. ❤️
