‼️Poland TODAY🇵🇱 Tusk and his “rule of law” – or how the prime minister turns the Constitutional Tribunal into a political obstacle course while pretending he’s saving democracyFor years Donald Tusk thundered about “PiS lawlessness,” “the capture of the state,” and “the destruction of independent institutions.” The second he got back into power, it turned out his definition of the rule of law is surprisingly flexible. When it comes to the Constitutional Tribunal, he’s not fixing anything - he’s just swapping one political power setup for another, using the exact same methods he used to condemn. And he does it with so much nerve it’s hard to believe this is the same guy who was recently lecturing everyone about standards.Selective memory and selective lawTusk and his parliamentary majority decided that the Tribunal in the shape they inherited from PiS “isn’t a real court.” Convenient theory. It lets them ignore rulings, block the publication of judgments, and then - once judges’ terms expire - pack the institution with their own people while pretending it’s not politics, just “restoring the Constitution.”Problem is, that logic cuts both ways. If a Tribunal with judges elected by the previous majority is “invalid,” why do the new judges elected by the current majority suddenly become sacred, even when the president refuses to swear some of them in? Tusk’s answer is simple: because the Constitution says so. And when the Constitution doesn’t fit his plan? Suddenly “our Constitution isn’t perfect” and “a lot of things aren’t precisely regulated.” That’s not the rule of law anymore. That’s governing by whatever interpretation is convenient right now.President Nawrocki won’t swear in some of the judges elected by the Sejm. Tusk and company call it a “blockade.” In response, the new judges (led by Anna Korwin-Piotrowska) simply announce a “break in duties” for President Święczkowski and the vice-president, take over running the institution, and the police stand guard over the new reality. Then the prime minister walks out with a straight face and says “the legally elected judges were attacked,” and that a state of law differs from jungle law because “muscle and thuggery don’t decide who’s right.”This is peak hypocrisy. The guy who’s literally using the state apparatus to force through a fait accompli is moralizing about how politicians shouldn’t walk into a tribunal and start giving orders. Except his people just did exactly that - just from the other side and under a prettier slogan.Compromise? Only with people who surrenderIn his speeches Tusk rules out any compromise. He compares his opponents to a thief who snatches an old lady’s purse and then screams about violence when someone tries to take it back. Vivid image - except in this story he and his camp are both the victim and the judge, and the other side is just supposed to hand everything over and disappear.“On some issues there can be no compromise,” he keeps repeating. Translated from politician-speak: either you accept our version of the Tribunal, or we’ll call you forces destroying democracy - and if we run out of arguments, pro-Russian. Yeah, Tusk already managed to tie defense of the current Tribunal to “support from an army of Russian bots” and compliments from the Kremlin. Classic move: if you’re not with us, you’re with Moscow.Political appointments dressed up as “the most outstanding”Especially rich is that among the new judges you suddenly find people directly tied to the current government. A former minister from Tusk’s own cabinet gets the green light to run for the Tribunal, even though Tusk himself used to stress there shouldn’t be “the slightest trace of politics” in it. Suddenly he “couldn’t watch any longer” and takes responsibility for breaking his own rule. Because “the other side uses methods incompatible with the Constitution,” so he gets to do it too. This isn’t a repair job. It’s a personnel swap while keeping the exact same logic: whoever controls the Sejm and the state machinery gets to decide who’s a “legitimate” judge. What it all adds up toTusk isn’t solving the constitutional crisis. He’s deepening it and milking it politically at the same time. He’s creating a situation where we effectively have two competing bodies claiming to be the Constitutional Tribunal. Police, prosecutors, and the government stand on one side. The president and the opposition on the other. The institution that was supposed to be the guardian of the Constitution has turned into just another battlefield for power. The worst part isn’t that Tusk plays hardball. The worst part is that he does it under the exact slogans he used to deliver with moral superiority for years. “Restoring the rule of law is our duty. There is no other way,” he wrote. Shame that this “other way” looks suspiciously like what he used to call lawlessness. Only now his team is doing it, so suddenly everything’s fine.If this is the standard for a “state of law,” then in Poland the rule of law simply means: whoever wins the election gets to decide which institutions matter and which ones can be “fixed” by force. Everything else is just pretty words for press conferences. -RMC
