@KUT, if you’re going to publish a story titled “What really happened?” perhaps you should start with what the courts actually ruled.
The Texas Court of Criminal Appeals did NOT find Allen Causey actually innocent. The courts explicitly stated that actual innocence had not been established. His conviction was overturned on a different legal basis involving the State’s unknowing use of false testimony. Those are two very different things.
Mr. Ware (Innocence Fraudject), four separate courts have now rejected the claim that Allen Causey established his actual innocence. Yet you continue presenting your fairy tale version of events as though it were an established fact. It isn’t. At what point does your narrative give way to what the courts actually ruled?
KUT should have known better than to publish these assertions without checking the court record.
The district court judge described the evidence against the other individual as compelling, but made clear that this did not negate Causey’s possible participation. He was an additional suspect, not proof of Causey’s innocence.
The Polanco coercion claim was dropped by Causey’s own defense. It was not pursued and was not considered by the court. Why include it without explaining that???
And DA @JosePGarza’s subsequent dismissal of the murder charge was a prosecutorial and political decision, NOT a judicial finding of innocence.
These aren’t minor technicalities. They are fundamental facts of this case. Anita Byington and her family deserve accurate reporting, not a selective retelling that blurs the distinction between an ordering of a new trial and a finding of actual innocence.
If you’re going to tell readers what really happened, report the whole story.
Also, considering that this article was about me and the ad I participated in, why was I not contacted for a response to DA Garza’s claims? This is unacceptable, and I am demanding that the appropriate corrections be made ASAP.
I expect to hear directly from KUT management or an appropriate editorial decision-maker regarding these serious concerns. @England_Weber @corriemac @BenPhilpottKUT
Gov. Greg Abbott says Travis County's district attorney failed to keep a murderer behind bars. An opinion from the state's conservative Court of Criminal Appeals paints a different picture. kut.org/crime-justice/2026-1…
KXAN must run an apology and correction immediately. Their biased report is egregious.
PLEASE SHARE:
KXAN, is it normal journalistic practice for your publication to give DA Jose P. Garza a platform while not giving the other party an opportunity to respond?
Also, there are numerous factual errors in your story that must be corrected as soon as possible.
For starters, you call Allen Causey “exonerated.” That never occurred. A new trial was ordered. That does not equal exoneration.
The Texas Court of Criminal Appeals explicitly said it did NOT find evidence that Causey was actually innocent. It set aside his conviction and ordered a new trial—not a judicial declaration of innocence.
Strangely, KXAN claims the court deemed his confession “false testimony” because of Sgt. Polanco. That is not what the court’s ruling says. And CAUSEY’S OWN DEFENSE DROPPED THE POLANCO ISSUE before the decision. Any cursory review of the court records would make this clear. So, you FLAT-OUT LIED in this article. You believed DA Garza’s blathering story without bothering to check the facts. Yikes.
These errors and omissions fundamentally distort the case and change the meaning of what actually happened. Rather than independently examining the court record and presenting an accurate account, you are repeating DA Garza’s fairy tale version of events as fact.
Journalism requires verification, not simply providing a platform for one side to tell its story unchallenged. And I resent that nobody was contacted to speak up for Anita Byington and for justice.
I don’t know who is in charge of KXAN’s reporting on this matter, but I expect to hear from someone at your publication very soon. These inaccuracies must be addressed, and your readers, and especially Anita Byington, deserve a correction.

These Texas media are openly Dem partisan, propaganda, sources pretending to be professional news reporters. They'd rather conceal the truth than report it if it harms their political interests.
Hi @FBugenhagen_ and @adjectivejules since you “caught up” with James Talarico I’m curious why your story has the exact same excerpts as @kissphoria (Houston Choronicle) which are Talarico saying he attends ACL every year and is super excited to see Natasha Bedingfield. It seems to me like the Talarico campaign reached out to the Austin American Statesman and Houston Chronicle, told you to come take a staged photo opp of Talarico shaking hands at ACL, he then didn’t take any questions or do any interviews with you guys and instead gave you all the same dumb statement about loving ACL and what musical act he’d like to see.
Does that feel like journalism to you?
A nominee for the U.S. Senate in Texas was off the campaign trail for 13 days with less than a month until the general election and you guys represent the largest papers in Texas and you just show up and follow Talarico around like he’s Bono, get to ask him no questions and then put out the exact same reporting from what appears to be a 1 minute joint encounter with Talarico where he took no questions.

Five years ago, Attorney General Merrick Garland issued an infamous memorandum at the urging of the National School Boards Association and White House officials, directing the FBI and United States Attorneys to consider looking for a federal hook to prosecute parents exercising their right to free speech.
Today, we are releasing the “Report to Expose the Weaponization of Government Against Parents in Schools” which details Weaponization of the Department against these parents — from attempting to get the National Security Division involved to ignoring repeated warnings from employees that leadership’s actions could be unconstitutional.
Along with the report, we’ve released hundreds of exhibits and emails that make official and verify what many Americans had guessed: the Garland DOJ worked hand in hand with WH officials and the National School Boards Association to chill free speech and parental rights while they threatened to prosecute parents and label them domestic terrorists.
