Sadly-familiar facts include that: "For approx. 9-10 mins., [police officers] kept E.P. [a child with autism] pinned face down on the ground, handcuffed and shackled, using their own bodyweight to restrain him... E.P. expired on the scene.” Link: justice.gov/crt/case-documen… (2/2)

Is service of a summons required to apply to a court for an order confirming a foreign arbitration award? In a case of first impression, the Second Circuit held this week that it is not. Full opinion here: law360.com/articles/1536521/…

Today the Delhi High Court set aside a US$560 million ICC arbitration award rendered in 2015, on grounds it "suffers from patent illegalities and fraud and is in conflict with the Public Policy of India." (Antrix Corp. Ltd v. Devas Multimedia Pvt. Ltd). images.assettype.com/barandb…
Neat opinion from the 11th Circuit re. the FSIA's expro exception reminds that "'expropriation has a very precise meaning.' And to establish jurisdiction under the FSIA, the plaintiffs must show to the court that []actions satisfy that precise meaning." cases.justia.com/federal/app…
Unanimous #SCOTUS shuts door on 28 USC § 1782 discovery in aid of int'l arb: "only a gov'l or intergov'l adjud. body constitutes a 'foreign or int'l tribunal' [...]. Such bodies are those that exercise gov'l auth. conferred by 1 nation or multiple nations" bit.ly/3O9Qff8

Never thought I would see the day when ARSIWA, Twitter, and the WTO intersect. But here it is... Good catch @MPaparinskis. – at Manhattan, NY
A propos nothing in particular, do tweets count as State conduct for the purpose of attribution under international law of State responsibility? @wto panel in Saudi Arabia—IP says yes, for ‘the tweets [that] are in fact governmental tweets’ wto.org/english/tratop_e/dis…

Remember this day. 4/20/2020 marks the first time, ever, that the price of US crude oil futures fell below zero. Yes, you read that right. Negative. Prices. At this moment, sellers are paying BUYERS $37.63 for each barrel of WTI they agree to accept w/ May 2020 physical delivery. – at Manhattan, NY

As I imagine to be the case for many of you out there, Prof. Dolzer's masterful book was my first introduction to the enchanting world of investment arbitration. With his passing, the world has lost yet another great legal mind. Rest in peace. xitter.gq/StefanTalmon/status/12…
It is with great sadness that I have to report that Rudolf Dolzer, Director of the Institute for Public International Law at the University of Bonn from 1996 to 2009, passed away on Friday. He was a titan of general international law and a pioneer of international investment law.

#ICSID tribunal in Mr. Eyre & Montrose Devt. v. Sri Lanka declines jurisdiction. No evidence of contribution/risk in acquiring lake-side land --> no protected #investment. Shareholder claims are "parasitical" --> also fail. Award, ¶¶ 292, 297-303, 306: icsidfiles.worldbank.org/ics…
Mourning the loss of V.V. Veeder today - a giant in the field of international law who could make just about anything sound fascinating. He leaves behind a legacy built up over decades of pioneering scholarship and decisions: iaiparis.com/profile/vv.veed…
