If judge is correct that he admitted improper testimony, the remedy is new trial. That would give plaintiffs the opportunity to use a different approach to prove their case. But allowing plaintiffs to use the approach and then doing a switcheroo after the fact via JNOV is wrong.

@AlizaShatzman enjoyed returning to the California Appellate Law Podcast to speak w/ @NotTimKowal & @JeffLewisLaw abt the nuanced situation in the Fed Cir: an inquiry into Judge Pauline Newman’s alleged disability & workplace conduct. #CALP #judiciary #clerkships 👇
We can both acknowledge we owe a debt of gratitude to trailblazers like Judge Newman and also underscore that no judge should serve forever.

Just finished recording our interview of @steve_vladeck with @NotTimKowal. What’s wrong with the court making decisions on stay requests on its shadow docket and what institutional changes might remedy that problem? Fascinating, non-partisan approaches are possible…
Just in case you haven't read *enough* about #SCOTUS this week (or somehow want to read even more about it this summer), @BasicBooks is offering a 20% discount off of "The Shadow Docket" for orders placed directly through its website (code: "VLADECK20"):

Update: I hope everyone had a nice April Fool’s Day. Although our podcast is not actually expanding to Texas, the hosts of the Texas Podcast, @jodyssanders and @dtoddsmith , were gracious enough to come be interviewed on our show. No joke. That interview will drop on Thursday.

Big news. The podcast @NotTimKowal and I have been working on the last few years has really grown and we are going to be expanding to Texas. This is a natural move for me as I was born in Dallas, Texas. Look for the podcast to drop Thursday with rebranding as inclusive of Texas
