The Digital Services Act (DSA) is not optional. Any platform with more than 45 million EU users must comply. X violated three major requirements: (A) Deceptive “Blue Check” System — €45M fine After Musk made verification purchasable, scammers exploded: Fake government accounts Fake companies Fake emergency agencies Crypto scam accounts All using a blue badge to appear “official.” The EU calls this “deceptive design” because it misleads consumers and increases fraud. Meta, TikTok, YouTube, LinkedIn all avoided this fine because they kept verification separate from paid perks. --- (B) Political Ad Transparency Failures — €35M fine The DSA requires a public ad archive showing: Who funded the ad Who was targeted When it ran How much was spent This is meant to prevent election manipulation and hidden foreign influence. X’s archive was: Incomplete Unsearchable Missing required metadata Frequently offline The EU sees this as a major national-security risk during elections. --- (C) Blocking Independent Researchers — €40M fine Researchers studying: misinformation hate networks bot activity extremist recruitment lost access to X’s public data. Under DSA Article 40, this is illegal. Platforms must provide anonymized access for audits and risk assessments. X refused. This one is hitting Musk personally because CEOs are responsible for systemic risk compliance under DSA Article 52.
