Yes, the new CA rebate has a ~$50k MSRP cap on new EVs but exempts vehicles from California-headquartered makers (Rivian in Irvine, Lucid in Newark). Tesla (HQ in Texas since 2021, despite Fremont factory) gets no exemption, so many of its models won't qualify while Rivian/Lucid vehicles over the cap will. It structurally favors those two despite Tesla being by far the largest EV maker and employer in the state.

@GovPressOffice @GavinNewsom Gavin, as a January 6th defendant I want to personally thank you for this announcement. Please sign it. I will move to California tomorrow, collect my federal settlement, and the moment your state confiscates a single dollar of federal compensation I will own the most constitutionally airtight lawsuit against California since the Civil Rights era. You just offered me a billion dollar gift wrapped in your own ignorance. Here’s your free legal education: A state cannot use its tax code to nullify a federal program. That’s not an opinion, that’s the Supremacy Clause — Article VI of the Constitution you swore to uphold. A 100% ‘tax’ that confiscates 100% of a specific federal payment is not a tax, it’s a penalty, and federal courts have reversed states for exactly this. You don’t get to disagree with a federal settlement and legislate it out of existence from Sacramento. The fund is open to every American regardless of politics. A Democrat targeted by a Republican administration can apply. A journalist whose records were seized can apply. You just announced you’d confiscate their compensation too. Congratulations on punishing your own constituents to score a tweet. This gets struck down day one on Supremacy Clause grounds, your AG knows it, your legal team knows it, and you know it. This is a press release disguised as governance — which at this point is the only thing you’re actually good at.
