Any case with a footnote that starts, "Curiously, the 'just and reasonable' rate requirement for oil pipelines is nowhere to be found in the current U.S. Code" is my kind of case. See, 105 F.4th 418 (D.C. Cir. 2024).
Interesting case that shows one of the limits of current statutory compilation. Court wants to cite the Navajo-Hopi Settlement Act, which was in the US Code, but was removed in 2016 by OLRC during a reclassification. So, court cites the US Code as it existed in 2012...1/3
rather than the Act itself, because the Act has been amended several times. Of course, when you click on the link to the Code in WL, it takes you to the current US Code section which just says that the section has been omitted from the code. 2/3
New favorite federal district court alert. D. Mont. discusses postive law and cites The Shadow Code. Interesting case. Marquis v. Uecker, 2024 WL 416306.
Good reminder from the 9th Circuit yesterday not to rely on the organization of a U.S. Code title that hasn't been enacted into positive law.
Some news.
Following nearly 18 years of dedicated leadership, Kory Staheli has stepped down as director of BYU Law's Howard W. Hunter Law Library. @ShawnNevers, former deputy director of the Law Library, has been appointed as the new director.

I seem very interested in my water in this picture. Thanks to @nmignanelli and the @yalelawlibrary for organizing this symposium. And thanks to the other authors for teaching me so much.
Legal Information Symposium panel @yalelawlibrary with @carltonfwlarson @UCDavisLaw, @ShawnNevers @BYULaw. Joining virtually, M.H Hoeflich @kulawschool. Moderated by Femi Cadmus @YaleLawSch
Excited to present my paper “The Treatise and the Code” at @YaleLawSch @yalelawlibrary today.
I’m a child of the ‘80s, so can’t help but be excited to hear LeVar Burton at #LegalWeek23.
First time at #LegalWeek23. Who else is here from the Law Library world?
Looking forward to participating in this!

Always fun to find a donated book while doing research and wonder if the previous owner thought someone would be using it 110 years later.
Really looking forward to participating in this @yalelawlibrary symposium! library.law.yale.edu/news/le…
