$ABUS $ROIV $PFE $BNTX $MRNA Litigation Update 💥Judge gave Moderna until this Friday (14th) to file Protective Order, re: disclosure of Confidential Information ♟️Arbutus/Genevant filed Reply to Acuitas Response. ☠️‘127 Patent invalidated - was anticipated by ‘069 Patent
$ABUS $ROIV $PFE $BNTX As expected, counsel for Acuitas filed response letter. Up to Judge & time will tell, but think only one side is playing chess. Do respect this quip: “Defendants silently created—and were the sole entrants in—the slowest race to the courthouse ever…”

Finally! Genevant and $ABUS file infringement suit!!

$ABUS got another LNP patent allowed over the weekend. This patent covers the fundamental concept of using opposing flows to manufacture the LNP encapsulated mRNA product. It has a very early filing date, going back to the early 2000's. $ROIV $MRNA

Dennis Ding (Jefferies) put out a thorough 66 slide presentation “Framing the MRNA LNP Saga” analyzing the $ABUS situation. I recommend it. He puts fair value at $5/share for the core $ABUS business + $3-8 more for the probability adjusted value of the litigation opportunity.

This maps $ABUS patents to vaccines and candidates that likely infringe, and includes analyst estimates for the revenues (probability-adjusted for litigation and clinical success). This shows the asymmetric value opportunity that exists. $ROIV $MRNA $PFE $BNTX

Huge news! $ABUS and Genevant getting their ducks in a row!! Could mean 🤑
$ABUS & Genevant amend their X-Agreement. Huge news. Reading between the lines: there was a patent ambiguity in Cross-License Agreement, which each disputed. Since potential infringement actions against $MRNA $BNTX $PFE &/or Acuitas c/b many Billion$, better to shake hands. 🤝

$ABUS - The Patent Office issued ABUS it's newest patent this morning. IMO, the new patent covers both the $MRNA and $PFE / $BNTX vaccines. It has an effective filing date (for prior art) dating back to 2009.
In addition to covering the $MRNA Covid Vaccine, it looks like the new patent application that $ABUS got allowed on August 30, 2021 (app. no. 17/227802) also covers the Pfizer-BioNTech Covid Vaccine.

$ABUS Just listened to the oral arguments at the Federal Circuit. I think ABUS wins the '435 appeal based on standing, and it wins the '069 appeal on the merits.

$ABUS - Just finished watching the Genevant section of Roivant's R&D Day. I was glad to see them emphasize the importance of their intellectual property to mRNA vaccines.
