1/This lawsuit could be significant and yes (hope you’re sitting down) it is by 6 large ERISA plan employers against @UHC.
While important & significant, there are allegations that UHC acting as a “third party administrator” of the employees’ claims used AI/bots to deny claims illegally and compensated its own physician owned practices better than the independent practices.
The most important allegations come from the plaintiffs allegations on “shared savings.”
Shared savings occur when an out of network (OON) claim is administered by a 3d party, e.g. formerly Multiplan, now called Claritev, it negotiates or recommends a lower fee for the OON services and Claritev then shares the “savings” (the delta between the charges and initial payment) w/ UHC.
One might ask—“why should this occur under the NSA as the QPA (initial payment) is set at the 2019 median allowed amount for that CPT adjusted by a +28% CPI-U?”
That is what the NSA requires but we know from 3 CMS audits (2 released in the last 2 weeks) that the health plans are manipulating the QPAs downward (perhaps for shared savings), are not in compliance w/ QPA fee setting regs and not complying with QPA disclosure regs.
So, this case may importantly prove the axiom of the late great Charlie Munger: “Show me the incentive and I’ll show you the result.”

Am I the only one who remembers that on May 13, 2020, Amy Acton told the people of Ohio that 22% of Ohio COVID deaths were in long-term care facilities and the next day her agency published data showing it was 64%?
Replying to @kerpen
Ohio's weekly report is in. Acton said the nursing home/LTC death share was 22% yesterday. Report shows 63.7%!
Total is 674 from counties here: coronavirus.ohio.gov/wps/por…

In 2010, Fannie Mae got pulled off the NYSE. The stock was under a dollar.
Today $FNMA traded over $5. So I pulled up the NYSE’s actual rules for a brand new listing.
Minimum share price: $4. Done.
Pre-tax earnings: $10 million over three years. Fannie earns that in about four and a half hours. Freddie does it by breakfast.
Public float: $40 million. Fannie’s is worth over $5 billion.
They clear every number by a mile. And yet two of the most profitable companies in America still trade on the OTC, next to shell companies and penny stocks.
That’s not a technicality. On the OTC, a lot of pension funds and mutual funds can’t buy them. Index funds can’t hold them. Many brokers won’t let you margin them. The spreads are wider and the price discovery is worse. The buyers Treasury needs for a big offering are the ones the OTC keeps out.
Getting off the OTC doesn’t take Congress, a capital raise, or a new rule. FHFA pulled them off the exchange in 2010, and FHFA can put them back.
Midterms are tomorrow. Campaign season ends, delivery season starts.
@pulte, get $FNMA and $FMCC off the OTC and back on the Big Board. One letter, one signature. Let’s go

German police vans in Poland is proba ly a perfectly normal thing, showing Germany's support for Poland's sovereignty and democracy.
For anyone still failing to grasp the sheer gravity of what has unfolded in Poland since yesterday, or who has remained unaware because the mainstream media have conveniently buried the story, leaving social media as virtually the only source of information:
Tusk’s government ordered that the presidential aircraft carrying Poland’s Head of State, President Karol Nawrocki, be denied landing clearance. The military pilots, refusing to comply with what they clearly regarded as an unacceptable order, defied the control tower and landed anyway.
And what about Brussels?
Deafening silence.
No outrage, no condemnation, no defence of constitutional order.
We all know the routine: the moment the political damage becomes impossible to ignore, the Brussels establishment will rush to Tusk’s defence.
After all, he is von der Leyen’s political loyalist, and it is difficult to believe that he would have dared to take such an extraordinary step without the backing ,or at least the approval, of his political patrons.
This is not some trivial political spat. These are allegations of an extraordinary abuse of state authority, and they demand immediate answers. Poland deserves the truth, not a wall of silence from Brussels.

Polish MEP Dominik Tarczyński is explaining what is happening right now at Poland’s Constitutional Tribunal, calling it nothing less than a COUP D’ÉTAT!
“In Poland, we have a liberal-left government led by Donald Tusk, who is the Prime Minister. What is happening right now with the Constitutional Tribunal is that they want to take it over and fill it with their own people.
Why? Because they want to get rid of the Polish currency, bring us into the eurozone, and eliminate our secure borders. They are being pushed by the Germans, who want to spread the burden of illegal migration and send migrants to Poland.
First of all, the Polish złoty is our constitutionally protected currency. They have to change the Constitution to replace it, and without the Constitutional Tribunal, they cannot do that.
So, number one, they want to get rid of our currency and force us to adopt the euro and join the eurozone. Then they want to take our gold reserves, the largest in the European Union, to Frankfurt, to the European Central Bank, which is a German-based institution.
They also want to open our borders. And they want to make sure that when they lose the next elections, which are coming next year, the Constitutional Tribunal will be unable to do anything to stop their actions or reverse what they have done.
There are many more reasons, but I want you to understand one thing: they are under German influence. They are globalists, and we are fighting not just for Poland, but for Europe.
Be like Poland. Be strong. Our nation is strong, and we are going to win this fight!”

A new book says Dutch spies spent months watching Jared Kushner's iPhone screen in real time, and one of the things they saw him open was a bank account with about $750 million in it.
They got in because the Russians had already hacked the phone, and the Dutch found a way to ride along.
Here's how it went down, according to Matthew Cole's reporting in Vanity Fair. In late 2017, Dutch military intelligence found out a Russian GRU officer was about to travel to the UK. The guy was a dark-web hacker who dealt in stolen bank data. The Dutch gave him two options, work for them or get picked up by the British, and he picked the Dutch. He then handed over access to a GRU server in Rostov, and sitting on that server were screenshots from Kushner's iPhone X. So Russian military intelligence was already inside the phone of the man running America's Middle East policy.
From there, Dutch hackers in The Hague figured out how the Russians pulled it off and built their own way in. Cole says they could see his screen whenever he was using it, and they saved every frame. Sound was the one thing they couldn't get.
Think about what that means for anyone who uses WhatsApp or Signal. The encryption does its job while a message is flying between two phones. Once it pops up on a hacked screen, whoever's watching just reads it right along with you.
End-to-end encryption stops at your screen.
That's relevant here, because back in 2019 the head of House Oversight said Kushner's own lawyer had confirmed he used WhatsApp for official White House business and kept records by screenshotting his chats. The lawyer pushed back on parts of that account.
The Dutch have pulled this kind of thing on Russia before. In 2014, their spies got inside the network of Cozy Bear, the Russian hacking crew later tied to the DNC hack. They even took over the security camera in the hallway outside the hackers' office near Red Square and had photos of everybody walking in and out. When Cozy Bear went after the State Department that November, the Dutch tipped off Washington, and the Americans reportedly sent them cake and flowers as a thank-you.
As for the money, Cole alleges the Saudi and Emirati rulers put at least $2 billion into accounts tied to Kushner during Trump's first term. Kushner says every word is false and that the author never produced a single bank record. His lawyer is threatening to sue. The full book comes out October 27, so we're about to find out who has the receipts.
If Cole's sources hold up, there's a hard drive somewhere in The Hague with a frame-by-frame replay of the most sensitive phone in Trump's first White House.

⛔️A Huge International Scandal Involving Jared Kushner, Netanyahu, Mohamed Ben Salman‼️
⛔️ American Investigation Reveals That Mohammed bin Salman and Mohammed bin Zayed Bribed Jared Kushner, Trump's Son-in-Law, with Billions of Dollars in Exchange for Advancing Their Political Agenda Inside the White House, and That Benjamin Netanyahu Participated in the Secret Financial Transfers!
⛔️Vanity Fair magazine published a bombshell investigation by investigative journalist Matthew Cole from his book *Princes and Thieves*, revealing that Saudi Arabia and the UAE deposited no less than $2 billion into secret bank accounts for Kushner, in exchange for his commitment to work on advancing Mohammed bin Salman and Mohammed bin Zayed's agenda with Trump, with a role for Netanyahu in arranging the financial transfers and concealing their sources.
⛔️The story began with a hack of Kushner's phone by Dutch military intelligence in 2018!
⛔️According to the investigation, Dutch intelligence accessed secret files from Russian military intelligence, which included photos from Kushner's phone. Through analysis of the hack, the Dutch exploited a security vulnerability in his iPhone X, becoming able to monitor his screen while he used it.
And here's where the surprise came in!
⛔️Dutch intelligence discovered that Kushner repeatedly accessed a bank account in the UAE containing hundreds of millions of dollars, which had arrived via a bank in Azerbaijan. And most alarmingly, Kushner, according to the journalist's source, appeared to be transferring massive sums of money from this account to individuals, including a militia leader, a mercenary, and a former hired killer!
⛔️But where did the money come from? And why was it at the disposal of the U.S. president's son-in-law?
⛔️The investigation states that Mohammed bin Zayed and Mohammed bin Salman entered into secret arrangements with Kushner in 2017, at the start of Trump's first term.
⛔️Mohammed bin Salman was seeking to solidify his accession to the Saudi crown prince position, while Mohammed bin Zayed wanted to push the U.S. administration to scrap the nuclear deal with Iran, and Kushner wanted to leverage the two men's influence to impose a Palestinian settlement acceptable to Israel.
⛔️According to the investigation, bin Salman and bin Zayed offered to fund a secret slush fund to serve the foreign policy goals of the Trump administration, and they discussed allocating more than $10 billion, including funding political projects inside America to help Trump secure a second presidential term.
⛔️But the initial project changed, and it ended, according to what the magazine published, with the deposit of no less than $2 billion into at least two bank accounts to which Kushner was granted access, funded initially by bin Salman and bin Zayed, then by bin Zayed alone later on.
⛔️The first account: $750 million in the UAE!
⛔️The investigation reveals that around $750 million was deposited starting in 2017 into an account inside First Abu Dhabi Bank, whose board was then chaired by Tahnoun bin Zayed, brother of Mohammed bin Zayed.
⛔️The account was linked to the "Emirati Homeland" foundation, a government-funded entity that the investigation says was used as a front for financing secret Emirati military and intelligence operations abroad.
⛔️And most alarmingly, Mohammed bin Zayed and Tahnoun bin Zayed granted Kushner signing authority over this account, meaning he was not the legal owner of the funds, but he became bankingly able to dispose of them!
⛔️As for the money itself, it passed through Azerbaijani banks before reaching the UAE in U.S. dollars. The investigation explains that some Azerbaijani banks use complex financial arrangements to convert clients' money to dollars for commissions ranging between 6% and 7%, making it harder to trace the original source of the funds.
⛔️The second account: Around $1 billion in Israel under alleged oversight from Netanyahu!
