October has brought a significant new round of activity in HAM v. Karen Read & Aidan Kearney civil lawsuit. From the fight over David Yannetti's subpoena and the October 27th order from Judge Gildea, to competing appeals and Kearney's two applications for Direct Appellate Review before the SJC, there is a lot to unpack in the latest court filings. The documents, the arguments, the appellate proceedings, and what comes next: LIVE today at 12:15pm ET🩷💚 youtube.com/live/pa0F3OEqX88…

Dear Towel (@GrantSmithEllis) I write to you under Grave concerns. I fear that this gentleman, Andrew Baxter, may be working hard to continue the coverups regarding Karen Read and Sandra Birchmore. In a recent video, he said the tipsters "never mentioned grooming," as if it is their fault the Stoughton and Canton Police didn't follow up on the 5 tips referring to MFer. He refers to Sandra as a "sidepiece." This is a link to his website. Link to the video is below. He is one of Kate Peter's prime allies. He is a hardcore simp for the Forensicroom. In my eye, he is the continuation of corruption in both Sandra's and Karen's cases. youtu.be/H1HlNGUdzNM?si=xdgw… claritybureau.com/

I have a real problem with what happened in the jury room, and it is not with the holdout juror. The jurors openly admitted that the nurses on the panel used their medical backgrounds to “discuss and explain” Clancy’s medications and hospital records to pressure the lone holdout. That is a blatant violation of constitutional law. Introducing outside specialized expertise into a jury room is illegal. It bypasses the Sixth Amendment right to a fair trial. A juror cannot act as an unsworn expert witness. The defense and prosecution have a right to cross-examine every piece of expert testimony. They cannot cross-examine a nurse at the deliberation table. Juries must evaluate a case only on evidence officially admitted in court. The moment a juror uses professional credentials to reinterpret medical or toxicological data, they introduce extrajudicial information. The media slammed the holdout juror for “not following the law.” In reality, that juror was the only one resisting a corrupted, illegal deliberation process. Clancy jury drama is unprecedented? Think again. The law has already ruled on this. The nurses on that panel committed a massive legal violation. Look at People v. Maragh (2000). A defendant was convicted of criminally negligent homicide. After the verdict, it was discovered that two registered-nurse jurors used their personal medical expertise to calculate the victim’s blood loss and shared those “expert calculations” during deliberations to push a conviction. New York’s highest court overturned the conviction and ordered a new trial. The ruling was clear: 1. Jurors cannot use professional expertise to inject new, unreviewed evidence into the jury room. 2. Doing so turns a juror into an unsworn expert witness. 3. It violates the defendant’s constitutional right to cross-examine evidence. When a nurse juror says, “Trust me, I’m a nurse, let me explain these tox reports,” they are not just deliberating. They are breaking the law and corrupting the trial. The Clancy holdout juror was not the problem. That juror was the only line of defense protecting the Constitution from a rogue jury room.

Before we find out today’s DA election results there’s a few things I want to say: 💖 I wish all “politics” played out the way this campaign cycle did. This race drew people in to understand the issues, form an opinion and evaluate the candidates accordingly. 🧡 It transcended political party talking points, and not simply because of the fact that it was a single party primary. The issues at stake in this election are not unique to a single party and therefore candidates drew support from voters across the political spectrum. (😉 Let me know when we’re ready to talk about the fact that all issues are by nature apolitical) 💚 No matter who wins, the result is just the beginning and I hope if you got involved you’ll stay engaged because…say it with me…sunlight is the best disinfectant. 🩵 If you’re reading this as someone who voted for a different candidate than the one I supported and you’re gearing up to talk 💩 please go back to the top and re-read because this applies to your side too.

There's no room for hate in the DA's office. I hope an outsider will be elected and create a culture that doesn't welcome hate into it's ranks. The 2 people I care about most happen to be apart of this community which means I am too.

"The burden is self-imposed." - Judge Gildea That was one of the biggest moments from today's hearing over Karen Read's motion to compel Colin Albert's deposition. Colin Albert's attorney, Chris Mattei, argued that Colin is now in basic combat training, does not have his phone, has an intensive daily schedule, and that any deposition would require permission from the U.S. Army. He said he had even reached out to a Judge Advocate four times without receiving a response. Judge Gildea didn't dispute that the Army controls Colin's schedule. Instead, he focused on one fact: the subpoena had already been served before Colin enlisted. 🚨 Gildea repeatedly emphasized that subpoenas have to mean something. He said the burden was "self-imposed," signaling that voluntarily entering military service after being served with a subpoena does not automatically excuse compliance with that subpoena. Karen Read's attorney, Aaron Rosenberg, agreed that everyone respects Colin's decision to serve his country. His argument was regarding the timing of this choice. Colin already had outstanding obligations under a court-issued subpoena, and this is now the second hearing because Read's team still has not received the documents they subpoenaed. By the end of the hearing, Colin's attorney acknowledged that if Judge Gildea orders Colin to appear for a deposition, they will comply. The remaining question is what the Army will actually permit and how that deposition can be accomplished. To me, this was never about criticizing military service. It was about whether someone can voluntarily make themselves unavailable after already being served with a subpoena. Judge Gildea made it clear he is not prepared to simply let that question end the discussion. Because Attorney Mattei acknowledged he was still trying to determine the proper process for obtaining permission from the Army, Judge Gildea directed him to find out exactly what needs to be done to produce Colin Albert for a deposition. Judge Gildea also corrected Mattei after he referred to the subpoena as something "the other side says is disputed." "You may not want to say 'the other side says it's disputed.'" Gildea had already made clear that this was "a subpoena that was already served." His concern was no longer whether the subpoena existed or was valid. It was how the parties were going to comply with it. AKA, Colin's attorneys have one more shot before Gildea files a court order to produce him for the deposition.

Simply shocking. As I posted last week, deep rooted biases as seen in the texts impact every decision an investigator makes. They undermine the very constitutional safeguards that exist to protect the accused. Those protections completely collapse in the face of flagrant biases that undermine both the due process and sixth amendment rights of those accused of crimes.

Excellent thread about both why strangulation is an extremely serious form of domestic violence, and also why it can be very difficult to prove forensically. I don't know if Cooper did it or not but if the accuser says he did, her testimony is enough evidence to support a charge.
🧵 1/5 Update on the Jonathon Cooper case: what started as a misdemeanor criminal mischief charge after a June 4 domestic incident has now escalated. Court records show Cooper faces an additional felony charge of second-degree assault by strangulation, plus a misdemeanor third-degree assault charge. He has pleaded not guilty to the original charge and the case is pending. As someone who spent years investigating DV and homicide cases, I want to walk through why a case can escalate like this days later — and what it teaches us about strangulation evidence in general. #DomesticViolence #NFL #Strangulation

💜💜💜💜💜 With the criminal charges behind her, it’s time to shift focus to the family court case to reunite Kelsey with her baby. Kelsey has the following court dates, all scheduled in Salem: 💜4/14/26: Hearing on the 209A restraining order 💜4/23/26: Motion For Further Temporary Orders 💜5/1/26: Pretrial Conference The 4/14 hearing will be the first time Kelsey has an opportunity to address the ex parte allegations in the original affidavit filed by JA on June 30th. My understanding is that @BradlLawPC is handling that case. Here is a copy of the motion for further Temporary Orders filed by Attorney Hess which is now scheduled for 4/23: dropbox.com/scl/fi/7s0ovr5ft… #justiceforKelseyandcaidyn
