Summary of the Baby A case below. This is based on the full court transcripts with the help of ChatGpt and is for the Lucy Letby Innocence website.
#LucyLetby
Introduction
Baby A was born at the Countess of Chester Hospital at 20:31 on 7 June 2015, at 31 weeks and two daysโ gestation, weighing 1,660 grams. His twin sister, Baby B, had been born shortly before him. After initial support, Baby A was breathing spontaneously while receiving CPAP and was described as stable. On 8 June, at about 16:00, his cannula tissued, meaning that it was no longer usable because fluid was leaking into the surrounding tissue. He then received no intravenous fluids until after 20:00, although he received small amounts of expressed breast milk through a nasogastric tube: 1 ml at 16:00 and 1 ml at 18:00. A long line was inserted into his left arm at about 19:00 and a 10% dextrose infusion began running through the line at approximately 20:05. Soon afterwards, he suddenly deteriorated and stopped breathing.
The Sequence of Events
Nurse Melanie Taylor had been caring for both twins in Nursery 1 before handing over responsibility to Lucy Letby at around 20:00. Also in the room were Baby B being cared for by Nurse Caroline Bennion, and Registrar Dr Harkness attending to a third baby. Letbyโs account was that Taylor, as the sterile nurse, connected the fluids to Baby A, while Letby hung the bag and set the pump. Nurse Aโs January 2018 police interview recorded that Taylor connected the fluids and pressed start, while Letby helped check the bag and pump settings. At trial, Taylor could not recall who had connected the fluids.
After the handover, Nurse Taylor was at the Nursery 1 computer entering notes, with a direct line of sight to Baby Aโs incubator. She testified that she became aware, through the monitor alarm or display, that his heart rate and oxygen saturations had fallen. She initially remained at the computer, thinking he might recover and that Letby was with him, but went to help when the situation did not improve.
Letby said that Baby A had appeared jittery at handover, meaning that his limbs were jerking involuntarily, which she considered an abnormal sign. While checking the equipment at the incubator, she said the monitor alarm sounded and she noticed that his colour had changed. She described blotchy, red and purple mottling, almost like a rash, particularly on his hands and feet and the left side of his body where the line was, while he was centrally pale. She found him apnoeic, or not breathing. Dr Harknessโs retrospective medical notes state that he was called over to assist at 20:26. Letbyโs notes, written retrospectively at 07:56 the following morning, recorded: โAt 20.20 Baby Aโs hands and feet noted to be white. Centrally pale and poor perfusion. Baby A became apnoeic.โ
Dr Harkness removed the long line at 20:27, concerned that it might be connected to the collapse. At trial, he said that its position was not ideal, but that it was usable. The defence challenged the lineโs position, while prosecution expert Dr Bohin considered it not optimally positioned but safe to use. He intubated Baby A at 20:28 and resuscitation continued with chest compressions and emergency medication. Dr Ravi Jayaram responded to the emergency call and arrived at 20:33 according to medical notes recorded by Dr Christopher Wood, who was acting as a scribe during the resuscitation. Despite resuscitation efforts, Baby A was pronounced dead at 20:58. The original post-mortem examination recorded the cause of death as "unascertained".
The Allegation
The prosecution alleged that Letby had deliberately injected air into Baby Aโs circulation through a vascular line, causing a fatal air embolism. Prosecution experts Dr Dewi Evans and Dr Sandie Bohin considered air embolism the likely cause, relying in part on accounts of unusual skin discolouration. Dr Evans referred to the 1989 paper โPulmonary vascular air embolism in the newbornโ by Lee and Tanswell, which described skin changes observed in some cases of pulmonary vascular air embolism. Myers argued that the medical literature supporting a link between skin discolouration and air embolism was limited. He told the jury that the Lee and Tanswell study examined 53 infants, with discolouration reported in about five cases, and that the specific description of bright pink vessels against a cyanosed background came from a single case. He challenged how far this evidence could support a reliable diagnosis of air embolism in Baby A.
Skin Discolouration
Dr Jayaramโs police statement of 18 September 2017 described โflitting patches of pink areas on the background of bluey grey skin; these patches seemed to appear and disappearโ. In cross-examination, Ben Myers KC suggested that the Lee and Tanswell paper, which Dr Jayaram found in June 2016, had influenced his recollection. Dr Jayaram had not recorded the flitting pink skin discolouration in his contemporaneous clinical notes, nor had he mentioned skin discolouration in his statement to the coroner. Myers challenged him about these omissions and questioned the reliability of his later description. Dr Jayaram denied that the paper had influenced his account.
Other witnesses also described unusual skin discolouration, but their accounts varied. Nurse A described โpurply blotchiness with white that Iโd not seen beforeโ, although her earlier police statement had described Baby A as centrally very pale, with unusually white limbs. No other witness described patches of skin discolouration that appeared to move, disappear and reappear as Dr Jayaram described. At trial, Dr Harkness described unusual and striking patches of skin colouring but said that the patches he observed did not come and go. He had not documented these unusual patches in his contemporaneous clinical notes, and Ben Myers KC also challenged him about this omission in cross-examination.
Other Expert Witnesses
Professor Owen Arthurs identified an unusual line of gas in a large blood vessel on post-mortem images. He considered the gas an unusual finding, consistent with but not diagnostic of air having been administered. He could not establish from the images alone that an air embolism had caused Baby Aโs death. Other possible explanations for gas included its introduction through a catheter or during resuscitation, as well as post-mortem changes.
Dr Marnerides testified that pathology could not establish air embolism and that, on the pathological findings alone, the cause of death remained unascertained. He considered the pathological findings, including possible air bubbles in the lung and brain tissue, suggestive but not conclusive. His ultimate opinion that air embolism was the likely cause of death was based on a combined assessment of the pathological findings, the clinical assessments of Dr Dewi Evans and Dr Sandie Bohin, and the radiological evidence and opinions of Professor Owen Arthurs. He said: "I took the view that the death would be explicable on the basis of air embolism."
The Defence
The defence argued that there were significant concerns about the medical care Baby A received before his collapse. He was a very premature, clinically vulnerable baby who had been without intravenous fluids for at least four hours. The long line inserted by Dr Harkness was not in the best position and had not been moved, while nurse Mel Taylor was responsible for both Baby A and his twin, Baby B. The defence also questioned whether Baby Aโs observations and deterioration had been adequately monitored. Against that background, Baby A collapsed approximately 20 minutes after the dextrose infusion was started through the line. The defence argued that these circumstances, together with the pressures on the neonatal unit, provided an alternative context for his sudden deterioration. It emphasised that there was no evidence that Lucy Letby had physically harmed Baby A or accessed the line after Taylor had connected it and started the infusion.
The defence also challenged the medical evidence that an air embolism had caused Baby Aโs death. It argued that Dr Evans and Dr Bohin relied heavily on a limited body of research, particularly the paper by Lee and Tanswell, and that the clinical features they citedโincluding sudden collapse, skin discolouration and the presence of gas in major blood vesselsโdid not conclusively establish an air embolism. The defence questioned the reliability of the descriptions of Baby Aโs discolouration, pointing to differences in the accounts given by clinicians and the absence of contemporaneous documentation of some of the more striking descriptions. It also argued that Professor Arthursโ radiological findings were not diagnostic of an air embolism: the gas could potentially have been introduced accidentally or deliberately, could have been associated with resuscitation, or could have arisen after death. The defence maintained that the images did not establish that air had been deliberately injected or that it had caused Baby Aโs collapse.
Finally, the defence relied on Dr Marneridesโ evidence that the pathological findings, considered on their own, did not prove that an air embolism had occurred. Although he considered some findings suggestive, he acknowledged that they were not absolute proof and that his conclusion depended on consideration of the clinical history and radiological evidence alongside the post-mortem findings. The defence argued that this combined evidence still did not provide a sufficiently reliable basis to conclude that Baby A had died from a deliberately induced air embolism, still less that Lucy Letby had caused it. Its central submission was that the prosecutionโs theory depended on drawing conclusions from Baby Aโs collapse, the presence of gas and Letbyโs presence on the unit, without sufficiently establishing the mechanism of harm or linking a deliberate act to her.
