If you read @Cobratate habeas corpus petition and understood that the outdated 1903 Supreme Court standard is still being applied in extradition cases, you would understand what they are challenging. The courts are still relying on a standard established in 1903. The legal standard for bail in extradition cases goes all the way back to Wright v. Henkel in 1903. More than 120 years later, it has never been overturned by the Supreme Court, and courts are still applying it today. What makes this especially interesting is that Whitaker Wright was facing extradition over alleged financial fraud involving false company statements. The Supreme Court held that bail should not ordinarily be granted in extradition cases, while leaving room for exceptional circumstances. That same special-circumstances standard continues to make bail extremely difficult to obtain. The Tate brothers’ lawyers challenged its constitutionality, but the judge said she was bound by existing Eleventh Circuit precedent. So despite more than a century of legal developments, this 1903 standard remains in place. The other issue is that there is a more modern standard under 1984 Bail Reform Act, but it applies to defendants in the U.S. domestic criminal justice system. So that system only applies to people who are in jail or prison . But, those held pending international extradition are subject to a standard that still dates back to 1903! A system that modern judges refused to overturn.
