But is the EU going to formalise tiered membership? I'm curious to know what the label offers Canada and the EU.
The EU was split today over whether to offer “associate membership” status to Canada, with several countries refusing to sign off on a statement containing that phrase just 48 hours before a summit between the two sides in Montreal. vist.ly/5q6qw

Fine. Tell the US PM to bring it up in WTO committee. I'm sure the EU will have lots to say about US market volatility and unfair competitive practices.
NEW!!! U.S. Trade Rep. Greer is pressing the EU for answers after the European Investment Bank awarded Airbus its largest-ever loan, raising fresh questions over a deal to pause U.S. tariffs on EU imports Greer warns the financing could violate commitments on aircraft subsidies

I'd evaluate the tweet as I would a student essay. Beyond the news, explain your causal inferences. Can USTR unpack the relationship among the variables? What evidence can USTR offer to support a relationship between higher tariffs and these investments? Offset market volatility?
President Trump’s trade and tariff policies are restoring America’s status as a manufacturing powerhouse, creating jobs and bringing production lines back to U.S. soil. Check out the @WhiteHouse’s tracker highlighting the surge of investments since @POTUS returned to office: whitehouse.gov/investments/

Elders event last night at @LSELaw with interventions from President Zedillo, who gave a measured but scathing review of US trade tactics & Prof Susan Marks, who reminded us how easily int’l law could be a shield for lawlessness, and urged us to stay vigilant with a critical eye.

I suppose the question is whether US officials are nervous about all the Canadian press concerning forthcoming European talks.
The latest we’re hearing on US-Canada talks: Hassett says talks have “picked up” and they’re “very close” to a deal. It’s been LeBlanc and Lutnick (not Greer), but a U.S. official tells me the Canadians aren’t offering enough right now. No word yet today from the Canadians.

Why has an Alberta referendum made it difficult for USTR to negotiate? Have US mid terms made it impossible for this administration to?

So 338 is meant to empower the POTUS to impose tariffs after finding evidence of specific disadvantages relative to treatment vis a vis foreign products…not based on exemptions raised by a Senator…unless we’re backtracking investigations?
Collins statement confirms

338 depends on found factual evidence of discrimination of US commerce. But if the US liberalised trade in an FTA have to wonder how such disadvantages hold up. If you negotiated and agreed, that is. Historically, 338 was a tool to press for asymmetrical reciprocity with Canada.

So... the anti-coercion instrument?
Merz interesting on China today Didn't name China in speech but got asked in Q&A. On kill switch, from speech: "It will enable us to respond swiftly & vigorously to targeted attacks on our industry & supply chain, with the idea being in best case we will not have to use it"

When the American Society of International Law IEL group, led by Wolfgang Alschner, asked me to join a group to discuss blogging, my first thought was: Who would spend time on a session about this? Judging by the interest, at least a few people.

We have a number of good questions lined up for discussion. But let me say this. There are some very clear benefits and costs to devoting time to blogging. More than anything, it fuels the current discourse and adds immediate value to those practising the law.

If you are keen to have an impact in this way, it's vital to become comfortable in this space. But I distinguish thoughtful interventions from voluminous noise; authors seeking to write frequently and loudly, if only to put themselves ahead of the work. Anyway, more to discuss.

I remain unclear how this trade tool would operate. ACI on steroids? Without the prevention? What of due process and accountability? What about harm to trusted partners? Persuade partners to align? Subject to international review? Cut off but also rebalance? Thresholds?

This weapon would allow Brussels to rapidly cut off market access when a trading partner causes severe economic distortions or engages in coercion It would mark a dramatic shift in the EU's trade policy - now it's on the table.

I worry that EU leaders imagine there is some magic weapon hidden behind a secret door ready to be unlocked. But there is no easy answer to Europe's economic competitiveness. And the politics cannot get behind the right policies until that reality sinks in.
New: EU leaders to ‘urgently’ call for new trade weapons to tackle China shock Leaders of EU’s 27 member states will instruct Brussels to “urgently” come up with new weapons to counter imbalances caused by China’s economic policies, at a summit tomorrow scmp.com/news/china/article/…

A safeguard, as compliant with WTO rules, would only come after the appropriate investigation of impact on a domestic industry, not as a negotiated outcome. So this is better understood as mutually settled trade management.
💥Confirmation of EU-China trade deal detail: - Yearly quota of 350,000 hybrid units with fixed annual increase adjustment rate of 6%. This will cut by more than half the current Chinese exports to the EU, which is estimated to reach around 800,000 units in full year 2026

And by the way, there are WTO conditions for a selective safeguard, including a commitment to consider what is equitable to all suppliers, eg. UK, Japan, and Korea.

Tried to explain the relationship of Art XIII and AS Article 5.2 better in long form as it’s not entirely clear. On LinkedIn for now.

Yes. It resembles the US push for use of non-violation complaints and rebalancing of security measures. Bypass some of the formal stickiness of compliance to make a woolly compromise that suits present politics.

Reading between the lines: All sounds very airy fairy in current climate, but optics of this deal surely a huge boon to China. Can show the world that it values WTO & system. Can negotiate a deal with a big power. So it's a PR win that soothes ties with major trade partner
