So ... the initial decision to withhold the obstetric records in the Letby case was made by lawyers?
Were they assisted by a suitably qualified clinician - perhaps an obstetrician - in assessing the records' potential medical significance?
The CPS's FOI response provides no evidence that they were.
And the prosecution's principal medical expert, Dr Dewi Evans, acknowledged that he had never examined the full obstetric records, yet maintained that they were irrelevant.
So who, if anyone, was medically qualified to assess whether those records might reasonably assist the defence?

If the CPS approached the Letby case on the assumption that she had deliberately harmed the infants, their obstetric histories might initially have appeared irrelevant to the prosecution's case.
But if the infants deteriorated for other medical reasons, those same histories could have been critical to Letby's defence.
The CPS initially withheld the obstetric records. Following a specific defence request in November 2022, it reconsidered and determined that some of the requested material met the disclosure test.
So how was the potential medical significance of these records assessed in the first place?
Perhaps a further FOI request could establish whether any registered medical practitioner, particularly a qualified obstetrician or neonatologist, was consulted before the initial non-disclosure decision. If so, what were their qualifications, specialty and role? When were they consulted, and which records did they examine?
The subsequent change in the disclosure assessment raises a legitimate question about whether the potential relevance of the obstetric histories to alternative clinical explanations was fully appreciated.
In an ideal world, the purpose of disclosure is not merely to support the prosecution's explanation, but to ensure that material capable of challenging it is made available to the defence.

It is documented that the NCA's recommendation of multidisciplinary Expert review of the initially selected cases, including the involvement of an expert Obstetrician, was deemed 'unnecessary' by Dewi Evans. He clearly (incorrectly) held the view that the maternal, antenatal..

They weren't just important for a 'few post-natal hours' @guyrowlanduk. The Maternal medical status, Antenatal and Delivery histories of the #LucyLetby indictment cases were critical in influencing their entire neonatal course and subsequent development and health.

It's a fair question.
The unregistered ex-paediatrician expert witness couldn't see why records of the pregnancy & birth might possibly be relevant to how the baby is doing a few hours later.
Who knows, perhaps the lawyers did seek medical counsul and asked him.

2/3 Reverse the sequence and read backward from the incident, and you stop the moment you find the nurse standing at the incubator. Because you refuse to travel further back into the timeline, you blind yourself to the actual causes of deterioration that occurred earlier.

1/3 When you trace events chronologically through prenatal period, birth, obstetric notes, & neonatal notes, every clinical detail acts as a stepping stone. By the time you reach the nurse at the incubator, the collapse is explained by natural causes +/- sub-optimal care.

3/3 Failing to provide the obstetric notes facilitated this backward process. Instead of evaluating the baby's true baseline, the trial was reduced to the defence trying to convince the jury that prosecution hypotheses were untrue.

Maybe the something to hide is the fact that Robin Spencer KC & judge lives in Chester .
According to Wikipedia attended the King’s School where Dr Ravi Jayaram , Stephen Cross & Matt Hancock attended so all part of their Alumni .
Don’t forget either that Robin Spencer was the lead prosecution barrister in the Sally Clarke case who coincidentally lived in Cheshire
He fought to not have Sally’s case referred back to the Court of appeal but eventually she was referred & subsequently exonerated.
Then as a judge he was a sole judge who refused Lucy leave to appeal
Think you can safely say he is not impartial or unbiased .
