Two potential flaws here: First, His manner of entry with a B1/B2 is a Visitor Visa. If he knew he was going to marry Annie, he entered with the wrong Visa and misrepresented his actual intent: to marry, which would require a FiancΓ©e Visa, and invalidate the βlegal entryβ which was obtained through potential fraud.
Second, if he filed the I-485 under Biden, he had to take the Covid shot. Reportedly, he refused to take it. The case may have been filed and denied and he never filed an I-485 again under Trump. Hence the DHS statement, no pending applications. Since nothing was pending, he is removable as an overstay.
The family seems very confused and someone dropped the ball, but it wasnβt DHS.

Anything that promotes self righteousness they are drawn to.
They have a deep need for superiority. Bullying the gays is easier than addressing the widespread sin of gluttony in their churches.
They attack what they are not and affirm the sins they are.
The church is the example of hypocrisy and the best advertisement for atheism.

In the late 60s early 70s I went to a Baptist church after we moved to a bigger town for better schools. Parents wouldnβt let me play with their children because my mom was divorced. She got divorced on grounds of desertion! Didnβt matter. She was a scarlet woman. Assholes.
