1. Any reasonable Crown would conclude, in deciding whether to commence this prosecution, it didn't meet the standard to prosecute. Soon after the trial started, it would have been more obvious & that increased until the evidence concluded. Even then,... cbc.ca/news/canada/livestory…

2. ...the below quote from it was pointed out as insight. But, the role of a prosecutor "is not to obtain a conviction" but to see that justice is done in a fair process. The Crown must constantly evaluate whether a conviction is likely & consider the public interest. #law

That is not the case here. The judge exonerated the accused, saying that based on the facts "actual consent was given."

The idiots at @Fanatics right now:
The tough thing about holding your new uniforms for an unveiling is keeping all the third-party corporate partners in line with the launch, when there's so little oversight with those. Fanatics ad leaked through USA Today Network, appearing to show Lions' new look jerseys.

This was one of my favourite Sankoff Seminars. I strongly recommend this particular seminar and subscribing to @ProfSankoffsCDE generally. Remember that no matter how busy you are, you have to take some time out of your schedule to sharpen the tools in your toolbox.
If you can join me today, you should. The alternative (non joke) title to this is: "Suggestions about How to be a Better Criminal Defence Lawyer", things I've learned after almost 10 years doing appeals.

Howdy #LawTwitter folks. I have a pretty interesting manslaughter case in London from October 16th to 27th. If any law students at Western or Fanshawe would like to observe, I invite them with open arms. email me [email protected] or text me 519-792-9391.

My client is 3rd on the indictment, I'm 3rd in terms of counsel seniority, and we are aligned with co-accused on many issues, so I will be uniquely prepared to offer insight to students that would make this a more active learning experience than typical trial observation.

To be perfectly clear: I AM NOT looking for free labour and expect no research, errands, or perfect attendance from any students who might wish to observe. Reminder to email or text, not DM, as I do not come on to this hellscape very often anymore.

A follow-up to this piece from the weekend. The Ford government has faced accusations of patronage for bringing back the King's Counsel title for lawyers and awarding it to numerous Tory loyalists thestar.com/news/gta/2023/07…

I just thought of a submission I should've made yesterday so looks like I won't be sleeping this month and on random nights here and there for the rest of my life.

Very happy and proud to announce that Jennifer Penman has been appointed as a Justice of the Superior Court in Toronto. Justice Penman will serve with the same integrity, intelligence and commitment that she demonstrated so often as counsel.
