The FT reported that US businesses complained about the cost the revised Product Liability Directive. They are right but they missed an important (and sizeable) point: the largest negative impact that the PLD is on the EU economy itself. Here is what the data says:

The German transposition of the revised EU Product Liability Directive (#PLD) is entering a crucial phase ⚖️🇩🇪. The upcoming hearing in the Bundestag’s Committee on Legal Affairs and Consumer Protection underscores the importance of getting national implementation right, particularly in light of new digital and AI-related liability risks and the need for Germany to respect in its implementation the European Commission's stated intention that PLD does not reverse the burden of proof.
As the debate progresses, the European Justice Forum (#EJF) continues to follow developments closely, contributing legal and policy insights on how the PLD can be transposed in a way that ensures legal certainty, effective consumer protection 🛡️, and coherence with existing liability frameworks.
The German discussion will be closely watched beyond national borders 🌍, given its potential implications for PLD implementation across the EU 🇪🇺.

Blame all the major powers for the failure of the WTO. Meanwhile we are being talked into treating dependencies as something bad because it can be weaponised. This is an incredibly dangerous distortion of trade.
ECIPE retweeted
Worth a reminder that among those seeking to weaponise trade is the EU, and while that's the case any involvement in trying to firm up trade rules is going to be pretty tokenistic.
A bit more self-awareness would not go amiss in Brussels.
"Weaponisation of trade in an atmosphere of mistrust is a clear and present danger to the global economy that seems likely to worsen until it is taken seriously."

Quantum: Another perspective
While investment tells one story,
company presence tells another.
EU leads with the highest number of companies (~65–70) broad and diversified ecosystem
US follows closely (~60+) strong private sector + startup dominance
China (~25–30) fewer companies, but likely more state-driven concentration
UK (~35–40) punching above its weight
The second layer (very important)
Germany, Canada and France mid-tier ecosystems (~15–20)
Avustruralia, Japan and Netherlands growing (~10+)
Israel, Finland, Switzerland, Korea and Denmark smaller but highly specialized clusters
What stands out
EU breadth (many companies)
US depth (innovation + capital)
China state-backed concentration

Japan’s quantum ambition
Striking: Australia, Denmark, Singapore, Spain, India, Netherlands and Canada may not be high-tech leaders yet, but they seem to understand where the future is heading, and are already placing their bets on quantum.
Why quantum matters: Quantum technology is not just another innovation wave.
It has the potential to:
- Break current encryption systems
- Transform drug discovery and materials science
- Optimize complex systems (logistics, finance, energy)
- Shift the global technological balance
What the data shows
Japan stands out with ~$7.4B in recent commitments - the largest among the listed countries
- UK and Germany (~$3.2–3.5B) steady, structured investment
- US (~$3.2B total across years) more distributed, multi-phase funding
South Korea (~$2.3B) consistent strategic positioning
- Others (Australia, Spain, India, Canada…) smaller but expanding participation
These countries are not just investing in technology, they are investing in future power

UK trade policy remains stuck in Brexit simplisms as I wrote yesterday, unable to escape traditional attitudes towards US and EU, and left with little to contribute to wider debate- but at least that isn't as destructive a position as previous or elsewhere ecipe.org/insights/strugglin…

Last week in📍Stockholm, @FredrikErixon presented a new report by the @ECIPE, "Consumer Protection in the Age of AI: Transposing the New EU Product Liability Directive in Sweden, Denmark, and Finland". 📊🌍
Commissioned by the #EJF and authored by @FredrikErixon together with @osguinea, Dyuti Pandya, Vanika Sharma and @renata_zilli, the study examines the potential impact of the revised EU Product Liability Directive (#PLD) on growth, research and development, and digital competitiveness, with a particular focus on Sweden, Denmark and Finland. 🤖📈
During the event, Fredrik Erixon presented the report’s key findings, highlighting that unclear definitions and expanded liability exposure for AI and software could discourage innovation and investment if national implementation is not carefully calibrated. ⚖️
As several Nordic countries are among the first EU Member States advancing national transposition proposals, Sweden, Denmark and Finland provide an important early look at how the new liability framework may shape the region’s innovation ecosystem. The discussion highlighted the importance of striking the right balance in implementation - ensuring strong consumer protection while safeguarding Europe’s competitiveness in emerging technologies.
A timely discussion on how the revised Product Liability Directive may affect innovation, investment and digital development in the Nordic region and across Europe. 🌐

🗣️ “The EU’s new Product Liability Directive risks stifling digital innovation in the Nordic countries by expanding liability to AI systems and software. In transposing the PLD, Nordic policymakers have an opportunity to lead. By tailoring the Directive to their proven model, they can continue to champion both world-class innovation and robust consumer protection in the digital age.”
Agata Boutanos, CEO of European Justice Forum
A new report by the @ECIPE, commissioned by the European Justice Forum, examines the potential impact of the revised Product Liability Directive (#PLD) on growth, research and development, and digital competitiveness particularly in Sweden, Denmark and Finland. 📊🌍
The study, authored by @FredrikErixon, @osguinea, Dyuti Pandya, Vanika Sharma and @renata_zilli, cautions that unclear definitions and expanded liability exposure for AI and software could discourage innovation and investment if national implementation is not carefully calibrated. In response, all three countries have begun advancing transposition proposals, underscoring the urgency of adopting an innovation-friendly approach.
As several Nordic states are among the first EU Member States to bring forward national transposition laws, policymakers now have an important opportunity to ensure that implementation preserves both strong consumer protection and economic dynamism. ⚖️📈
The report sets out five key policy recommendations:
1️⃣ Ensure legal clarity in relation to digital technologies and AI liability through national guidance.
2️⃣ Seek interpretative guidance from the European Commission to promote harmonised implementation across Member States.
3️⃣ Limit excessive liability exposure through proportionate transposition and the development risk defence.
4️⃣ Clarify the interaction between the PLD and existing digital and data legislation.
5️⃣ Preserve the ombudsman-led model as the primary channel for consumer redress.
We would like to thank #ECIPE for their excellent and thorough work on this important report. 👏

Recently in The Hague 🇳🇱, we took part in the presentation of @ECIPE's report - Collective Action in the Netherlands: Why It Matters for the Transposition of the Product Liability Directive 📘.
The report explores the implications of the Netherlands’ transposition of the new EU Product Liability Directive (#PLD), with a particular focus on how it interacts with the Dutch collective action system. As one of the first EU Member States to implement the PLD - and a key hub for mass litigation - the Netherlands offers a compelling case study for policymakers and stakeholders across Europe 🇪🇺.
Key features of the Dutch system, including low claim thresholds, opt-out mechanisms, flexible settlement structures, limited cost-shifting, and the relative ease of establishing litigation-backed entities, make the jurisdiction especially attractive for mass claims. These elements further reinforce the Netherlands’ reputation as a “litigation magnet,” raising important questions about legal certainty, innovation, and access to justice under the new liability framework.
A timely discussion on how EU product liability reform will play out in practice, and what it means for the future of collective redress in Europe. 👏 Thank you, @FredrikErixon for the insightful presentation, @osguinea, and Vanika Sharma on putting light on the increasing risks rising from the mass litigation connected to the Product Liability transposition across the EU🇪🇺📊.
