Mark, you are welcome to help anyone you like. Fund any clinic. Pay the premiums. Build Cost Plus. Nobody is stopping you, and nobody will in a free country.
That is not what you are proposing. You are proposing that every working American be made to fund your idea whether they agree with it or not. Your choice of motivations is yours. It does not become a claim on anyone else's paycheck, and calling the claim help does not change what it is.
Read your own post again. Every example in it is voluntary. The entrepreneur picks his reward. The worker picks his employer. The customer picks what to buy. Those people are all traders, owner and employee alike, and each arrangement stands because both sides said yes.
But then you want a Treasury payroll deduction from everyone. A trade you cannot refuse is not a trade. It is the one thing in your entire post nobody chose.
Capitalism is not an economic policy. It is the social system in which all property is privately owned and all human relationships are voluntary, which means it is the political form of freedom itself. The only thing it bans is the initiation of force. That is why the signal are the result of voluntary choices, as you say, and also why your plan is outside it. The moment you reach for the Treasury you have left capitalism, and no amount of good intention brings you back in.
So the question is simple. Why do you believe it is right to confiscate one man's earnings against his consent to fund an idea you think is good? If the idea is good, people will invest in it voluntarily. You have raised money your whole life. You know what it means when nobody will write the check.
Capitalism and Medicare for All are not two options on the same menu. One rests on consent and the other on force, and you cannot run both on the same patient. What we have now is the remnant of a free market in medicine, and the record since 1965 is not in dispute. Medicare projected at $9 billion, running $444 billion. Premiums doubled after the law that promised to cut them. Three quarters of insurer revenue already tax money. Prices climbed in exact step with the government's share, and you want the share to be all of it.
Capitalism works for everyone who trades. What it refuses to do is give any man a right to another man's life, and that refusal is not its failure. It is the reason a free man can walk into a hospital in the first place.
Profit isn't the only signal. Feeling great about helping people. Changing people's lives. Helping your country. Putting people in a position to succeed. To enjoy their lives. People get to pick their own motivations. If they are fortunate, they will reach those goals.
That's the beauty of capitalism. People get to choose the reward that motivates them.
Entrepreneurs can choose to make as much money as possible. Or not. They can choose to make enough money to focus on using their most valuable asset, their time, to not have to work at all. They can choose to make money to help people.
But. Every entrepreneur that wants to reach their goals needs people. People to work for them, buy from them, sell to them. Even the person in the basement with nothing but AI, needs to connect to humans to reach their personal goals.
Capitalism works. But not for everyone.
Where Capitalism fails people, Capitalism isn't the problem. It's the people that put profits above all else that are the problem.
If you put your personal net worth or cash flow above all else, you may make insane amounts of money, but you will suffer the greatest indignity. You will be hated. Your time will not be your own. You will never experience the joy that comes from helping others.
No one is born knowing where their life will take them. We get to do our best, in our circumstances, to try to enjoy our lives.
Capitalism allows us to try to get there. Capitalism allows people who have achieved those goals to help others. Capitalism allows us to choose our own personal path.
Unfortunately, we don't all get there. But we get to try to choose the path we want.
The signal is personal choice. Not profit.

BREAKING: President Trump announces he has offered the White House Press Secretary job to UFC President Dana White.

I think a lot of people are completely wrong about what caused this midterm "blue tsunami."
I also believe that much of the hyperbolic, misguided analysis is coming from people who have hated Trump for a long time and who have been eagerly waiting with bated breath to declare the end of Trump and MAGA.
"It was obviously the Iran War. Trump didn't put America first. He betrayed America. It was gas prices. Only a fool would think otherwise."
Ok. Fair enough.
Allow me to present a hypothetical scenario. Let's pretend that Trump #2 never started the war with Iran.
Imagine if the price of gas was not around $4.00 a gallon but instead, let's say something low, assume $2.70 a gallon.
Pretend inflation was at a near perfect 2% for the year and GDP was cruising along at a 15 year high.
Assume wages were up and unemployment was at about a 50 year low.
No war. Great economy. That would have won Republicans the midterms right?
That would have prevented Democrats from flipping 41 House seats and 5 Governorships?
Those hypotheticals I listed above are what was happening in 2018 before the midterms. And yet, Democrats flipped 41 House seats and 7 Governorships during the midterms.
The Senate races turned out differently because Democrats were defending races all around the country in 2018. Republicans took back a couple red states. But the 2018 midterms were considered a massive blue wave for Democrats. No Iran War, economy booming, and still, that's how the midterms turned out.
Here's a fun fact. There were approximately 35.5 million Democrat votes during the 2014 midterms. There were approximately 61 million Democrat votes during the 2018 midterms.
25 million more Democrat votes during a booming economy. Do the current criticisms of Trump's second term explain that?
Trump went from 63 million votes in 2016, to 74 million in 2020, to 77 million in 2024. During each of his three midterms (2018, 2022, 2026), the Republican vote has increased substantially. But those increases do not compete with the additional 20 million Democrat vote bumps that happened in 2018, 2020, and 2026.
The question for Republicans becomes why do these gigantic Democrat vote bumps happen. How are they doing it? Is it because people hate Trump? They hate his policies? If those things were true, he would not continually gain support for himself and for the Republican Party.
Without even touching voter fraud, I believe that there is a clear, multi-faceted strategy that Democrats employed in 2018, 2020, and 2026 to drive insane amounts of people to polls, regardless of economic conditions. It's not difficult to identify, but Republicans don't talk about it and certainly don't have an answer for it. And Democrats can do it at will when needed.
Yes Trump won in 2024, but he was the only Republican that would have won and his win was helped by some unprecedented circumstances. Democrats were caught off guard. They did not make that mistake this time around.
Trump's second term has been far from perfect. Lots of mistakes and unforced errors. And once again, many terrible personnel choices by Trump.
That being said, I also believe that things could have been close to perfect right now and Republicans would have still gotten crushed during the midterms. Look at 2018.
Perception is everything. Republicans are not prepared or even willing to step on to the field with Democrats in this regard.
The Democrats are a cohesive, well oiled, united machine working in perfect harmony with the MSM. Together they can create and push any narrative they want to push. Republicans not only have no answer to this, they instead spend their time fighting each other.
Democrats don't argue about policy. They create mass hysteria and fear. It's all emotion. It's their entire platform. Most Americans don't like their policies. But they are playing a game in which policy and ideas and reality do not factor into the equation. And there are very clear strategies that they use to create this mass hysteria and to drive voter turnout.
Republicans are just going to keep helplessly watching this happen over and over again. They learned nothing from Trump's first term. The exact same lies, smears and hoaxes were used again, except this time around they replaced Russia with Epstein. Same game plan to the tee. For example, they created the same immigration hysteria that they did in 2018. Everything happened again.
Democrats were doing No Kings/Fight Fascism protests back in 2018 over immigration. People don't remember this but they were. I've posted videos about it. Bernie proudly declaring "No Kings." The immigration hysteria is especially effective at getting women riled up.
People don't remember Kamala Harris taking a ladder to climb a fence to break into an ICE facility in 2018 or Rachel Maddow fake crying on TV, AOC crying at the fence, or Oprah holding her book club at the border. Protesters literally glueing themselves to the ground in protest (over nothing). A Time Magazine cover with Trump menacingly towering of a crying migrant child. The audio recording of a baby crying that the MSM played on repeat for weeks before the midterms. The British PM Theresa May publicly condemning "kids in cages" (the same cages that Obama built and used).
Republicans just sat idly on their hands and watched it happen all again, making no attempt at rebuttal. Democrats are on TV every hour of every day. Republicans politicians can't even bring themselves to post on social media in defense of enforcing the law. No matter who the next Republican President is, if he or she attempts to enforce immigration laws, Democrats will turn it into a midterm win. Guaranteed. And that's just one weapon in their playbook.
Republicans don't even know how to deal with the sabotage coming from their own side, let alone unite in a perception war with the Democrat Party.
Before the 2022 midterms inflation had reached a 40 year high, gas was above $5.00 a gallon, more people died from Covid in 2021 than in 2020, the botched Afghanistan withdrawal happened, the border was wide open and Biden was struggling to walk and talk. Still, Democrats only lost a few House seats and even picked up a Senate seat.
With all that happening, why didn't 20 million more Republicans vote during the 2022 midterms than in 2018? If economy matters so much, why was there no red wave? Have an election "expert" answer that one.
People who are playing Monday morning quarterback and criticizing everything Trump has done this time around are so not prepared for or even aware of the war that is being waged. They most likely care. They are ok with losing and many just want to declare all things Trump dead and buried. Maybe next election they will decide to fight back against the incredible machine Democrats. Good luck with that.
The Republicans who are so joyfully celebrating the end of "Trumpism" are in for a rude awakening when he's gone. Trump has increased his support and Republican support in every Presidential and midterm election he has been involved in.
I'm going to lay out in another post some detailed thoughts on the strategies Democrats have used to turn out massive amounts of votes and what Republicans might consider doing in response. It's nothing genius but there is a clear, detailed method to the Democrat madness and nobody seems to be talking about it or even care about it.
Granted, I'm just a guy on X who doesn't know much, but it doesn't hurt to post my thoughts so I will.

DIVORCE AGREEMENT
THIS IS INCREDIBLY WELL-PUT, AND I CAN HARDLY BELIEVE IT'S WRITTEN BY A STUDENT!!! WHATEVER HE RUNS FOR, I'LL VOTE FOR HIM.
Dear American liberals, leftists, social progressives, socialists, Marxists, and Obama supporters, et al:
We have stuck together since the late 1950s for the sake of the kids, but the whole of this latest election process has made me realize that I want a divorce. I know we tolerated each other for many years for the sake of future generations, but sadly, this relationship has clearly run its course.
Our two ideological sides of America cannot and will not ever agree on what is right for us all, so let's just end it on friendly terms. We can smile and chalk it up to irreconcilable differences and go our own way.
Here is our separation agreement:
Our two groups can equitably divide up the country by land mass, each taking a similar portion. That will be the difficult part, but I am sure our two sides can come to a friendly agreement. After that, it should be relatively easy! Our respective representatives can effortlessly divide other assets, since both sides have such distinct and disparate tastes.
—We don't like redistributive taxes, so you can keep them.
--You are welcome to the liberal judges and the ACLU.
--Since you hate guns and war, we'll take our firearms, the cops, the NRA, and the military.
--We'll take the nasty, smelly oil industry and the coal mines, and you can go with wind, solar, and bio-diesel.
--You can keep Oprah, Whoopi, Bill Maher, Michael Moore and Rosie O'Donnell. You are, however, responsible for finding a bio-diesel vehicle big enough to move all five of them.
--We'll keep capitalism, greedy corporations, pharmaceutical companies, Wal-Mart, and Wall Street.
--You can have your beloved lifelong welfare dwellers, food stamps, homeless, homeboys, hippies, druggies, and illegal aliens.
--We'll keep the hot Alaskan hockey moms, greedy CEOs, and rednecks.
--We'll keep Bill O’Reilly and Bibles and give you NBC and Hollywood.
--You can make nice with Iran and Palestine and we'll retain the right to invade and hammer places that threaten us.
--You can have the peaceniks and war protesters.
--When our allies or our way of life are under assault, we'll help provide them security.
--We'll keep our Judeo-Christian values.
--You are welcome to Islam, Scientology, Humanism, political correctness, and Shirley McLaine. You can also have the UN., but we will no longer be paying the bill.
--We'll keep the SUVs, pickup trucks, and oversized luxury cars. You can take every Volt and Leaf you can find.
--You can give everyone health care if you can find any practicing doctors.
--We'll keep "The Battle Hymn of the Republic" and "The National Anthem."
--I'm sure you'll be happy to substitute "Imagine," "I'd Like to Teach the World to Sing," "Kum Baya," or "We Are the World."
--We'll practice trickle-down economics and you can continue to give trickle-up poverty your best shot.
--Since it often so offends you, we'll keep our history, our name, and our flag.
Would you agree to this? If so, please pass it along to other like-minded liberal and conservative patriots and if you do not agree, just hit delete. In the spirit of friendly parting, I'll bet you might think about which one of us will need whose help in 15 years.
Sincerely,
John J. Wall
Law Student and an American
P.S. Also, please take George Clooney, Ted Turner, Sean Penn, Martin Short, Charlie Sheen, Barbra Streisand, and (Hanoi) Jane Fonda with you.
P.P.S. And you won't have to press 1 for English when you call our country.
Forward This Every Time You Get It !
Let's Keep This Going, Maybe Some Of It Will Start Sink in.

Medical care is produced. It exists because men spent decades learning to make it, and because other men put capital at risk on the scanners, the surgical suites, the sterile manufacturing lines, the labs and the beds. Call it a right and you have placed a claim on all of it. Rights are freedoms of action, not claims on another man's work.
Everything for Everyone regardless of cost asks reality to stop having identity.
At zero price, demand runs unbounded. Supply does not. Something has to ration. Price does it in a market, and that same price tells producers where to build next. Kill the price and the queue takes over. CBO's own low rate option pays hospitals 13% less and drugs 23% less, then flags provider congestion. The savings and the shortage are one event.
Mercatus puts the bill at $32.6 trillion over ten years, more than doubling every federal income tax dollar would cover. CBO has GDP 1 to 10 percent below current law by 2030.
The capital goes first. A controlled rate sets the return on every machine anyone might buy next, and below a certain return the machine does not get bought. Canada is the proof. Second highest spender as a share of its economy among 32 universal systems, and it ranks 28th of 31 on MRI units, 28th of 31 on CT scanners, 26th of 31 on hospital beds, 30th of 32 on doctors. Germany runs 32.5 MRIs per million. Canada runs 10.6. The money funds the queue instead of the thing that would end it.
So the median wait is 28.6 weeks. 23,746 died on those lists last year, 100,876 since 2018. Lung cancer survival is 21.2 percent here against 13.3 in the UK.
Now look at your stakeholder list. Every party is there but one. The doctor who will not take your rate and the investor who will not build at that return get no seat, because they are not meant to answer. They are meant to comply. For them the commission arrives with a gun.
That is Cortlandt.
You mistook yourself for Roark. What you are is Keating.
For those who say it’s time for universal care. I am all for it. It would be nice if we could find a way to reduce the cost of care and make it available to everyone, for anything.
But it will take work to get there. Other countries with Universal Care make “Most Things available to All People”. It’s not perfect.
In our country, we make “Everything available to Most People”.
The question for this country, unlike others, is how we can make the best possible care and therapies, regardless of cost, to everyone ?
Read @AbdulElSayed ‘s book on Medicare for All. He wisely had more questions than answers. Medicare for All ? Global Budgets ? Or something else ?
It’s a difficult path from where we are to “E4E” Healthcare. ?Everything for Everyone)
My hope is that we can put together a Simpson Bowles type, Blue Ribbon Commission. One that includes representatives of all stakeholders. From all different type of patients. Including rare disease parents. Rural and Urban Hospitals. The most expensive hospitals that offer unique care. Pharma companies that offer everything from genetics to Cell and Gene Therapies. You get the point
Some people think we can just tell all those working in the healthcare system what to do.
That’s the fastest way for this to fail. We need to be as close as we can to being on the same page. And we need to figure out a non partisan manner of running our American version of Universal Care.
No reason we can’t start now
Replying to @RepDavids
You do know the tax credits didn’t expire - only the enhanced tax credits, correct? If you don’t know this, why the hell are you in government?
Average annual wages in 1988: $19,300
Average home price in
1988: $112,000
Annual wage average in
2026: $72,000
Average home price in
2026: $400,000
Both of these home prices are approximately 5 1/2 times the average annual income for those years.
One difference in the ability to own a home today is that more households in 1988 had 2 income earners.
Ever-Married Rates have Dropped: In 1980, about 90% of 35-year-old men had been married; today, that figure has dropped to around 60%. For young adults around age 25, ever-married shares are near historic lows (roughly 20% to 23%), compared to much higher peaks in decades past.
Beware the Large Welfare State:
France has one of the most comprehensive social protection systems in the world, with high tax-to-GDP ratios (around 46%) used to fund universal healthcare, generous pensions, unemployment benefits, and heavily subsidized public services.
Over 800 millionaires have chosen to move out of France.
So how many jobs went somewhere else?

Rep. Robert Garcia is the one who should be lawyering up. On Wednesday, billionaire Leon Black filed a $7.25 million defamation lawsuit against him in federal court in New York.
Garcia, the ranking Democrat on House Oversight, went on TV after Black’s June voluntary interview and claimed Black was “at the center of Jeffrey Epstein’s crimes,” was “directly involved,” that survivors “credibly named” him for direct abuse of women, and that he was among the last people to interact with Epstein before his death. Black’s lawsuit says those statements were false and made with knowledge they were false. Black has maintained he paid Epstein roughly $158 million for tax and estate planning work, cut ties in 2018, and had no knowledge of or involvement in Epstein’s crimes.
Garcia is in serious trouble because the defamatory comments he made against Black were made in a TV interview, not on the House floor, in a committee hearing, or as part of any official legislative proceeding. Media appearances by members of Congress generally don’t get Speech or Debate Clause protection. That means Garcia can’t simply wave the privilege and make the case disappear. He’ll have to defend before a judge the specific claims he made about Black’s alleged involvement in the abuse and trafficking.
Black has already been held in contempt by the House for defying Oversight subpoenas. Now the congressman who’s been the most aggressive in tying him to Epstein’s crimes is the one facing a defamation claim over statements made outside any official proceeding. Garcia’s office hasn’t yet responded.
This is what happens when a lawmaker goes on television and treats unproven allegations as established fact. The lawsuit is real. The statements are documented. Garcia has serious legal exposure here. I’m glad he’s getting sued by Black.
Garcia isn’t above the law.

Understand the implications of what happened in Texas last night.
Gina Hinojosa has called on Gov. Abbott to end state & local cooperation with ICE & she can order that on day one.
Hinojosa voted against the 2017 SB 4 as a TX state rep. The bill was essentially a sanctuary cities ban and required TX law enforcement to cooperate with ICE detainers. She then voted against another SB 4 in 2023, which made it a state crime to cross illegally into Texas.
Should there be another border crisis in coming years, there will likely be no resistance from Texas at the border. No Texas DPS, no TX National Guard, no razor wire or water buoys, and no Operation Lone Star, which Hinojosa called a “dog and pony show” and “political theater”.
Remember when 15,000 Haitians surged illegally into Del Rio, TX in 2021 under the international bridge? That was only stopped because Texas DPS responded on Abbott’s orders and physically blocked further crossings by lining up their cruisers to form a wall. The Biden Border Patrol was caught off guard and offered almost no resistance, except for some horseback agents who were falsely slandered for “whipping”.
Additionally, because Republicans failed to pass any legislation codifying President Trump’s border security measures, if Dems take the White House in 2028, that Dem president could, if he/she wants to, reverse every single Trump border security policy immediately upon taking office because they were all done at the executive level, and they can order Border Patrol to go back to a passive catch & release policy like we saw under Biden.

CALMATE, REPUBLICANS!!!
Trump remains president for the next two years. Deal with it, Democrats.
A Democrat House has no powers to prosecute. The DOJ will not indict. Impeachment will not lead to a Trump conviction and expulsion from office.
Stupid tax, spend and legislation will be vetoed—and won’t be overridden.
After there is some sort of resolution of the Iran War, gas prices will drop like a stone.
And by the way, the threat of a nuclear armed Iran will be substantially diminished, if not eliminated. Thank you, President Trump.
It’ll be fun watching Speaker Hakeem Jeffries try to control the crazy DSA/socialist/antisemitic caucus— and enact legislation to improve “affordability” as “affordability” is being improved despite the lack of legislation.
The economy is already growing—and will soon kick into an even higher gear.
For the next two years, the economy will continue to fire on all cylinders, while inflation and gas prices fall the moment the Iran War ends.
What will the Democrats’ argument be then? Raise taxes on “the rich”? “Medicare-for-All”? “Trump is a Nazi”?
Given that Democrats opposed no tax on tips, opposed no tax on overtime, opposed no tax on Social Security and refused to expand school choice, etc., Democrats cannot possibly take credit for the Trump/Republican economy.
They cannot possibly, with a straight face, take credit for the huge, and by recent standards, upcoming unprecedented growth in the economy.
The Republican 2028 presidential nominee—whether Vance or Rubio—will have a hell of a strong argument about the economy and “affordability.“
See you in 2028!

🚨🚨THE DEMOCRACY FILES / ILLEGITIMACY PLAYBOOK, PART 14: TRUST-ENGINEERING 🚨
This is the last Democracy Files drop before Election Day on November 3, 2026.
No matter the election results, ask yourself those questions:
• Why do protests even work at all?
• Why does "nonviolence" work as a tool of regime change?
• Why do color revolutions work at all?
The Democracy Files document efforts that are seeded over multiple years, through building of a massive civil society that can mobilize on a snap of fingers. This civil society is supported by training judiciary, creating so-called "independent media" to amplify agendas, a fractal network of NGOs reaching into every demographic, massive amounts of foreign aid / philanthropic dollars, and so-called "international solidarity."
But what is the atomic unit behind all those dollars, activists, lawyers, journalists?
You are. Or more accurately, your trust is.
Think about it:
What if nobody believed there was a such thing as an organic protest? Then the imagery of Eastern Europeans storming buildings cease to be a spotaneous truimph of liberty and start looking like something much more engineered.
Tonight's Democracy Drop focuses on how our trust is engineered by invisible sources around us to create legitimacy for the NGO-Administrative Complex.
They go to lengths to hide their own existence; in one segment, they go from saying "nobody" funds them to admitting "some people get paid" to declaring the existence of 200 networks and 1,200 groups.
They've engineered plans for all outcomes in tomorrow's elections. No matter what happens, there will be a new narrative being forced upon us top down.
Think hard and carefully on who you will trust to navigate the aftermath, especially as we enter the "danger period" revealed in the Democracy Files of November 3 - January 3.
Hold fast to God. And vote straight Republican.

WHO IS WAJAHAT ALI? AND WHY IS HE THREATENING AMERICA WITH "FIRE" IF ABDUL EL SAYED LOSES?
I have been tracking Wajahat Ali for 23 years, ever since he first reached out to me as a young 20-something lawyer-playwright to pitch columns to the Daily Beast and other liberal media outlets.
Over this long game, he has embedded himself deep inside liberal Democratic politics, MSNBC, the New York Times and John Podesta and @neeratanden's Center for American Progress.
He is the symbolic political "monster" of the red-green aliance's Dr. Frankenstein (to mix just a few metaphors).
Wajahat Ali is a protege of Hatem Bazian, the academic at UC Berkeley who co-founded Students for Justice in Palestine and American Muslims for Palestine with one agenda: the destruction of the state of Israel.
This will interest you @shaunmmaguire:
Wajahat Ali is the son of immigrant felons from Pakistan who were found guilty of stealing MILLIONS of dollars from Microsoft as part of a transnational FBI investigation called OPERATION CYBERSTORM. They are out of jail now after serving years in prison.
The case was so big that then-FBI Director Robert Mueller himself appeared at the press conference.
Wajahat grew up in a life of luxury in Fremont, Calif., because of his parents' stolen wealth. I drove by his former house. Most Americans couldn't afford the life he knew. Wajahat has claimed his parents were the victims of "Islamophobia"
America's redemptive story means that a child wouldn't be held responsible for his parents' crimes but the threats in Wajahat's new post reveal that he is a man who isn't extending any form of redemption to his political enemies.
My reporting reveals that the Democratic Party is at this moment of threats expressed against it by a keyboard warrior called Wajahat Ali because the party fails to understand the dangers of placating the rabid anti-Israel demands of Linda Sarsour, Hatem Bazian, Rashida Tlaib, Ilhan Omar, Hasan Piker and the rest of the anti-semitic lobby that has one goal: "FREE PALESTINE" by replacing the state of Israel with a state called "Palestine."
Here is the link to Wajahat's parent's criminal case: justice.gov/archive/criminal…
Wajahat Ali is a prominent figure in my book WOKE ARMY because he is a leader in the Honor Brigade of the Woke Army, threatening and intimidating anyone who dares to defy the narratives of the status quo establishment Muslim groups of Muslims as victims and non-Muslims, Israel and Jews as oppressors.

The rule: DELETE the poll book files after every election.
The law: KEEP election records 22 months.
The Court: "When an administrative rule conflicts with a statute, the statute controls."
One township clerk asked which law to follow. Nobody answered. So Michelle McQueer sued.
82 days later, she won. For EVERY clerk in Michigan. Starting with TOMORROW'S election.
And the Court directed the Secretary to write NEW instructions for all 1,520 clerks that follow the ruling. The poll book files go on encrypted flash drives and stay there for 22 months.
Remember what we said in October? Reconstruction is not preservation.
The Court agreed: "Retaining the metadata is as crucial as retaining the data itself."
READ THAT ONE TWICE.
The State's big burden? The Court found it's "at most, $100 per additional flash drive."
Thank you to the RNC and Michigan Republican Party for joining me in the fight.
The State can appeal. Until a court ever says otherwise, the poll books stay.
ONE CLERK. TWO LAWS. THE LAW WON.

PICK A CRIME: That's the choice Michigan Secretary of State Jocelyn Benson handed my client, a township clerk.
A new state rule Benson made orders my client to DELETE the electronic poll book records of the August 4 primary within 7 days of certification. What’s the problem? Federal law orders her to KEEP those same records for 22 months, into 2028.
Delete them? Face up to 1 year of imprisonment under federal law. Refuse? Up to 90 days imprisonment under Michigan law. Every path carries a penalty aimed at my client personally. For trying to follow the law.
My client wrote Jocelyn Benson and the Director of Elections on July 6 and asked one question: how do I obey both? Thirty-seven days. NO ANSWER.
So we asked a judge, while the records still exist. No more waiting around. Declare which law controls. Preserve the voting records.
And the part that should get your attention: the same rule governs the NOVEMBER election.
