LEGAL ANALYSIS: I’m gonna be fair here. Taco actually has a point and a legally defensible basis for the implication he’s making. Now, @Catholicizm1 most obviously has no intention of taking him out, permanently speaking, so there’s a legitimate issue regarding unreasonable escalation. But Anthony’s actual intentions aren’t dispositive. We have to remember, in most jurisdictions, the standard isn’t simply “fear for one’s life.” That’s a common misconception. You never actually have to feel “scared”. And it’s no different in Colorado. Instead, it’s an “actual and reasonable belief of imminent danger of death or great bodily injury/harm” BUT Colorado couples that with a “reasonable belief” that lesser force would be inadequate (compare w/the awesome state of FL. w/o such silliness). So, it’s not open season for @taco_talks either. This is where these cases become tricky. That inquiry has BOTH subjective and objective components. Meaning, the belief is evaluated in light of the person’s perspective, contemporaneously held information, and perception of the totality of the circumstances, while remaining subject to an objective reasonableness requirement. Each of those terms of art have their own definitions and it’s either statutory or jurisdictionally defined. Watch out you don’t become Chud the Builder now, lil buddy. @taco_talks Incidentally, Colorado, imposes no general duty to retreat on a non-aggressor, even when deadly force is contemplated. So it’s very nuanced. Now, let’s apply that to @taco_talks! Given the narrow gauge and obvious frailty of Taco’s little neck, coupled with his prior comments about his male masseuse job being too physically demanding on his pinky finger and his inability to hack it in jiu-jitsu, Taco has ample subjective grounds to believe he exists in a perpetual state of imminent danger of permanent incapacitation by even a low, 35 mph tropical-storm-grade gust. It’s no wonder he calls CO. home, knowing that anything in the Gulf region exceeds his physical sensibilities. Therefore, I would advise @Catholicizm1 against acting on his urges or desires. As we can see in this clip (and many others) Taco is heavily preoccupied with, and frequently practices, jerking things from his pants. That preoccupation is well-documented.
