🚨 “ 돌고래 판결 일부 언론 기사 문제점 “ ✅ 어도어는 위약벌을 40억 원으로 산정하고, 그중 10억 원만 일부 청구했습니다. 다니엘에게 위약벌을 1,000억 원으로 산정해 놓고 300억 원을 일부 청구하는 것과 같은 구조입니다. 📍‘일부 청구한 금액’과 ‘법원이 인정한 전체 금액’을 구분해야 합니다. ✅ 1심에서는 위약벌 40억 원이 인정됐습니다. 어도어 입장에서는 일부 청구한 10억 원 외에 나머지 금액도 추가로 청구할 여지가 있었던 겁니다. ✅ 그런데 항소심에서는 위약벌 총액 자체가 10억 원으로 대폭 줄었습니다. 어도어가 산정한 40억 원 전부를 인정한 1심과 달리, 전체 위약벌을 10억 원으로 제한한 판단이라는 게 핵심입니다. 📍당장 지급하라는 금액이 10억 원으로 같아도, 추가 청구의 전제가 되는 총액이 40억 원에서 10억 원으로 줄었기에 어도어에게는 1심보다 불리한 판이셈입니다. ✅ 앞선 항소심 변론에서도 돌고래 측은 구두 합의를 인정하면서 서면 동의가 없다는 이유로 위약벌을 인정한 1심 판단의 모순을 지적했습니다. 항소심 재판부 역시 돌고래 측 항소 이유에 더 이유가 있어 보인다는 취지로 발언했습니다. ✅ 그런데 이런 쟁점과 달라진 판단은 뒤로 밀고, 제목에는 ‘어도어 2심도 승소’만 내겁니다. 📍40억 원을 인정받았던 쪽이 2심에서 총 10억 원만 인정받았다면, 그 차이부터 설명해야 하지 않나요? ‘승소’라는 두 글자로 판결의 핵심을 가리지 마세요.
