They called it the new Child Focused Courts. They said the pro-contact culture was finished. Then the first appeal reached the Court of Appeal. The new President of the Family Division wrote it down: the new model has not changed the law. A mother asked the court not to put her children into direct contact with an abusive father. The family court ordered contact anyway. She appealed to the highest court in the land. The Court of Appeal ruled that the contact order must be left in place. What they corrected was the barring order that treated her like him. A new process. A Child Impact Report. Trauma-informed language. And at the end of it, he still gets the time, and you are still the one who has to make it look like a safe and healthy relationship - when it never will be. ⚖️ CASE LAW: ENGLAND AND WALES 🏴󠁧󠁢󠁥󠁮󠁧󠁿🏴󠁧󠁢󠁷󠁬󠁳󠁿 The court said an order would give a 15-year-old “emotional permission” to see his father, but he felt he was being forced. Nine months of refusal later, the same judge discharged the contact order between the 15 year old boy and his father. Of course, the mother was ordered to uphold the order, which she couldn't with a teenager who voted with his feet. The father sought to punish her via enforcement applications. But the order itself had become the problem, not the solution. He said he’d be more likely to go if nobody forced him to do it. 🚨Sky News has gone inside the secret family courts. A mother they call Laura says she was raped and abused. She disclosed it. There was a non-molestation order. The court process still turned on her. She fled with her son. She was extradited. She is in prison for child abduction. He is in care. From her cell: “I was targeted, manipulated, silenced, threatened by the system.” She takes responsibility for breaking the order. That does not make the system innocent. This is what happens when private law is allowed to run as a closed shop. Abuse becomes “allegations.” Protection becomes “alienation.” Flight becomes a crime. The child is placed with the state instead of the parent who tried to get him to safety. The new President of the Family Division now says the culture has to change.
