idk about indian politics, but american policymaking is moving away from this since 2025.
for 50+ years, everything funded by the federal government, like our schools, roads, criminal justice system, and healthcare, was designed to avoid unintentional discrimination or disparate impact. every lawmaker had to consider statistics about one racial group vs. another. a study or data showing disparities between groups ("castes") had enormous legal/political weight in lawmaking.
starting in 2025 with e.o. 14281, two landmark @TheJusticeDept actions in dec 2025 and jun 2026, and MANY supreme court rulings culminating in louisiana v. callais (2026), federal agencies are systematically excising disparate impact liability from the code of federal regulations where statutes lack explicit "effects" language, and constitutionally narrowing it where statutes codify it to avoid post-loper bright vacatur and equal protection challenges. simultaneously, they're booking the removal of disparate impact self-audits and validation studies as deregulatory cost savings.
today, at the federal level, we're directed and legally obligated to focus on the nation's people and good governance. judges have more discretion. policymakers are more free to debate fundamental political issues.
