Hi @DEXToolsApp We are writing regarding the recent change of our token name from “Asteroid Shiba” / “Asteroid” to “Ashiba” and the covering of the logo on dextool app. The name “Asteroid Shiba” refers to a publicly documented real-world object: the Shiba Inu plush zero-gravity indicator designed by Liv Perrotto that flew on the SpaceX Polaris Dawn mission. We use the name descriptively to identify a community tribute token related to that public event, not as a source identifier for the goods or services covered by EUTM 019350385. This falls under nominative fair use. The trademark owner has publicly stated that the plush toy copyright and original creation rights belong exclusively to the Perrotto family and that they only claim rights in the crypto space. Displaying the historical community name does not interfere with those claimed rights and respects the family’s ownership.Our token has used the name continuously since 10 September 2024 (pair creation timestamp 09/10/24 12:18:23 UTC). This predates the trademark filing date of 19 April 2026. Under both EU and common-law principles, prior continuous use creates rights that a later registration does not automatically extinguish.Users identify tokens primarily by contract address, not by the short display name. Our contract is [0xf280b16ef293d8e534e370794ef26bf312694126]. The trademark owner’s token uses a different address. Displaying our historical name does not create confusion as to the origin of goods or services. Dextools displays on-chain data and community-supplied names for informational purposes only. It is not offering, selling, or advertising the crypto software, wallets, exchanges, or other services listed in the EUTM classes. Platforms that merely index public blockchain data are treated differently from parties actively trading under a mark. Please provide concrete evidence that the previous name and logo caused consumer confusion or damage to the trademark owner within the EU market. Without demonstrated likelihood of confusion, a full name change and logo cover is disproportionate.The same (or very similar) names and logos appeared on Dextools for many months without issue. Sudden unilateral changes only after one party obtained a trademark raise questions of consistency. Do you apply the same standard to all tokens? The EUTM covers specific commercial services. A community memecoin chart listing is not “use in the course of trade” of those services. Dextools acts as an information aggregator, not a seller of the protected goods.The core EUTM is EU-only (with some WIPO extensions). The majority of our holders, liquidity, and activity are outside the EU and the designated countries, so display on a global platform should not be treated as pure EU commercial use. Changing the name and covering the logo of tokens that reference a public SpaceX mascot is disproportionate.
